《政府信息公开条例》中“国家安全”例外规定的完善

【摘要】：依法实施政府信息公开是依法治国的内在要求,是建设现代政府,提高政府公信力,保障公众知情权、参与权、监督权的重要举措。《政府信息公开条例》作为我国政府信息公开的一部基本法规,自2008年5月1日开始实施,这标志着我国政府信息公开制度的初步形成。该《条例》经过8年的实施,在推进政务公开,加快法治政府建设步伐、保障公民知情权等方面取得了显著成效。尽管如此,在实施过程中也暴露了诸多不足,包括法律制度自身存在的不足,制度在实施过程中存在的不足。本刊以我国"政府信息公开制度的实践与完善"设置专题:由中国社会科学院法学研究所提供的法治指数创新工程项目阶段性研究成果,就政府信息公开制度在我国社会实践过程中所存在的问题进行实证分析,并提出了相应的完善措施,包括:重大建设项目信息公开、社会保险信息公开;另外还包括新《国家安全法》出台后我国《政府信息公开条例》"国家安全"例外规定的完善;政府信息公开案件的司法审判等。以飨读者。
[Abstract]:The implementation of government information publicity according to law is the inherent requirement of governing the country according to law. It is to build a modern government, improve the credibility of the government, protect the public's right to know and participate in it. The regulations on the publicity of Government Information, as a basic law on the disclosure of government information in China, have been implemented since May 1st 2008. This marks the initial formation of the open system of government information in our country. After eight years of implementation, the regulations have achieved remarkable results in promoting the openness of government affairs, speeding up the construction of a government ruled by law, and safeguarding the citizens' right to know. In the course of implementation, many shortcomings have been exposed, including the shortcomings of the legal system itself. The deficiencies of the system in the process of implementation. Our journal set up a special topic of "practice and perfection of the government information disclosure system": the research results of the innovative project of the law index innovation project provided by the Institute of Law of the Chinese Academy of Social Sciences. This paper makes an empirical analysis on the problems existing in the system of government information disclosure in the process of social practice in our country, and puts forward the corresponding improvement measures, including: the disclosure of information on major construction projects and the disclosure of social insurance information; In addition, it also includes the perfection of the exception provisions of "National Security" in China's "regulations on publicity of Government Information" after the promulgation of the new "National Security Law", and the judicial trial of cases of open government information.
