我国对品种权侵权行为追究刑事责任应慎重

【摘要】：在《种子法》修订过程中,不少人基于品种权侵权普遍的严峻现实,提出应强化品种权的保护力度,对品种权侵权行为追究刑事责任,以遏制品种权侵权严重的发展态势。对品种权侵权行为追究刑事责任是一项非常严厉的处罚,应当十分慎重。对我国关于品种权侵权责任的基本内容、品种权侵权损害的利益、国际上关于品种权侵权是否追究刑事责任的情况、现阶段追究品种权侵权刑事责任面临的问题等进行分析,认为我国现阶段不易贸然对品种权侵权行为规定刑事责任,并就如何解决品种权保护实践中存在的问题提出相应建议,以期对《种子法》以及《植物新品种保护条例》的进一步修订有所助益。
[Abstract]:In the course of the revision of the seed Law, many people put forward that the protection of variety rights should be strengthened and the criminal liability should be investigated for the infringement of variety rights, based on the severe reality of the universal infringement of variety rights. In order to curb the serious development trend of variety right infringement, to investigate the criminal liability for variety right infringement is a very severe punishment, and should be very careful. To our country about the basic content of variety right tort liability, the interest of variety right infringement damage, The international situation on whether to investigate the criminal responsibility for the variety right infringement, and the problems faced in the investigation of the variety right infringement criminal liability at the present stage are analyzed, and it is concluded that it is not easy for our country to stipulate the criminal responsibility for the variety right infringement act hastily at the present stage. Some suggestions on how to solve the problems existing in the practice of variety right protection are put forward in order to be helpful to the further revision of seed Law and the regulations for the Protection of New Plant varieties.
