出版物法定呈缴制度中的补偿机制研究

【摘要】：出版物法定呈缴是保存文化遗产、保障信息资源自由利用的手段。文章对补偿机制的概念逻辑与主客体进行研究回顾;以58个国家和地区为对象,调查呈缴制度及其补偿机制的实践情况,分析各个国家和地区呈缴制度立法形式,归纳总结不同补偿方式及其代表性国家和地区,讨论补偿机制的实施效果;对电子、数字和网络出版物的呈缴制度及补偿机制的新动态进行跟踪调查,分析呈缴制度在立法形式、呈缴对象、呈缴方式上的特点与变化及补偿方式的多样化特点,在此基础上思考各个国家和地区制定或完善呈缴制度立法的可能方向,探讨补偿机制实施的可能性及必要条件。
[Abstract]:The legal submission of publications is a means to preserve cultural heritage and guarantee the free use of information resources. This paper investigates the practice of the payment system and its compensation mechanism, analyzes the legislative forms of the payment system in various countries and regions, summarizes the different compensation methods and their representative countries and regions, and discusses the implementation effect of the compensation mechanism. The new trends of the submission system and compensation mechanism of digital and network publications are followed up and investigated, and the characteristics of the system in the form of legislation, the object of submission, the mode of submission and the variety of compensation methods are analyzed. On this basis, the possible direction of formulating or perfecting the legislation of the submission system in various countries and regions is considered, and the possibility and necessary conditions for the implementation of the compensation mechanism are discussed.
