【摘要】：农业保险价格难题是导致农业保险发展受阻的主要原因之一，过高的费率需求方负担不起，，过低的费率供给方无能力供给，而农业保险的准公共物品属性为政府干预农业保险市场提供了必要性。市场主体按照市场机制提供农业保险产品，政府对农业保险价格进行补贴，价格的确定一方面决定了政府对农业保险的资金支持力度，一方面也决定了市场主体经济利润额度，农业保险的价格成为政府和市场双方利益实现的核心。根据权利义务一致的原则要求，享受政府补贴的农业保险定价权不可能完全将政府排除在外；再者政府作为公共事业的管理者，其对来自于公民财产转移的资金使用必须以促进公共福利，提供公共服务为前提，这一点也为政府应当在农业保险定价权中占有一席之地提供了理论支撑；最后，农业保险价格的复杂性尤其是风险区划工作所涉及的地域之广，数据之多，只能依靠政府强大信息组织能力方能完成。而农业保险市场化的运作、农业保险人的自主营业权以及主要赔付责任的承担使定价权自然而然也具有市场权利的属性。为保障农业保险定价的科学性以及效率性，让市场主导定价权，给予政府部分话语权的定价权归属模式便成为必然选择。公平制定农业保险价格，要遵循费率与风险相适应原则和各方可负担原则。为了按照这两个原则科学厘定费率，风险区划工作必不可少。《农业保险条例》作为《农业保险法》的过渡，欠缺规制政府公权力影响农业保险定价的具体法律制度。通过对定价权主体的立法授权、价格听证制度以及价格的公布等程序性规范有效限制公权力在农业保险价格中的滥用。除了程序性规范限制之外，一套独立的监管机制也十分必要。通过追责处理监管发现的问题是保障定价权公平行使的最后一道屏障。
