社会法视角下医患关系法律属性问题研究

【摘要】：近年来,随着社会经济的高速发展,患者的权利意识不断增强,人民日益增长的健康需求与现行的医疗卫生现状不相匹配的事实,使得当下医患关系空前紧张,不仅无利于患者合法权益的保护,也影响到我国医疗卫生事业的正常运转。从法理视角来看,要想合理解决医患纠纷,维护患者和医务人员双方的正当权益,实现社会之公平正义,确认医患关系为何种法律属性是亟需解决的问题。医患关系的法律属性决定着医患之间的权利义务分配、医疗纠纷处理和法律适用,有着重要的理论意义和实践意义。认真梳理医患关系法律属性的相关理论学说,可得知,以社会法视角为切入点研究医患关系,并提出重新定性后的法律构想,不失为妥善解决医患纠纷的合理解决路径。研究医患关系法律属性问题,首先,要界定医患关系和医患法律关系的基本概念,厘清医患关系与医患法律关系之间的关系,为论文研究奠定下理论基础。其次,要对医患关系法律属性纷争进行梳理与评析,对医患关系的民事法律关系属性、消费法律关系属性、行政法律关系属性、斜向法律关系属性、社会法律关系属性五种理论加以述评,引出医患法律关系属于社会法律关系这一观点。再次,对医患关系社会法属性的理论分析,在阐明社会法内涵、价值追求和现实意义之后,论证医患关系应在社会法范畴内调整的可行性和合理性。最后,在社会法视角下提出医患关系的基本立法构想,确立医患关系社会法属性下立法的基本原则,立法模式的选择以及多元化的纠纷解决机制的构建。
[Abstract]:In recent years, with the rapid development of social economy, with growing awareness of the rights, health status and health needs of the people increasing and the current does not match the fact that the current unprecedented tensions between doctors and patients, not only conducive to the protection of the legitimate rights and interests of patients, but also affect the normal operation of China's medical and health undertakings from. The legal perspective, to solve medical disputes, safeguard the legitimate rights and interests of both patients and medical staff, to achieve social fairness and justice, to confirm the doctor-patient relationship why the legal attribute is an urgent problem. The legal attribute of the doctor-patient relationship determines the distribution of rights and obligations between doctors and patients, medical disputes and applicable law, has an important the theoretical and practical significance. The legal attribute of the doctor-patient relationship carefully combing the relevant theory, that in the view of social law as the starting point of this relationship System, and puts forward the legal conception of redefining the reasonable solutions can properly resolve disputes between doctors and patients. The research questions, the legal attribute of the doctor-patient relationship first, to define the basic concepts of doctor-patient relationship and the legal relationship between doctors and patients, to clarify the relationship between the doctor-patient relationship and law between doctors and patients, to lay a theoretical foundation for the research. Secondly, to analyze and comment on the dispute of the legal attribute of doctor-patient relationship, attribute of civil legal relationship of the doctor-patient relationship, the consumer attribute legal relationship, legal relationship between the administrative legal relationship, oblique attribute, attribute of social legal relationship of five kinds of theory review leads to legal relationship between doctors and patients belong to the idea of social legal relationship. Thirdly, analysis of the patient the relationship between the nature of social law theory, to clarify the connotation of social law, after the pursuit of value and practical significance, the doctor-patient relationship should be demonstrated in the social law within the scope of adjustment Finally, from the perspective of social law, we put forward the basic legislative conception of doctor-patient relationship, establish the basic principles of legislation under the social law attribute of doctor-patient relationship, the choice of legislative mode and the construction of diversified dispute settlement mechanism.
