战后日本农地流转中的政府角色分析

【摘要】：一般而言,财产私有制下,土地作为农民的财产是可以在市场上自由流转的。但是,鉴于农地的自然属性和经济社会属性,农地流转具有极大的外部性。因此,农地流转不是完全市场交易行为,需要政府的调控与引导。战后,日本建立土地私有制,通过流转许可、合同管制、佃租限额等制度设计,严格控制农地流转。随着经济发展,土地流转管制的条件逐步放宽,日本政府由单一管制者向引导者、培育者等多重角色转变。但这种转变只体现了"谨慎的宽松",并未改变日本农地流转管制制度的构建基础和本质属性,也未撼动日本政府在农地流转中的主导地位。中国在大力推进农地流转和规模经营时,可参考日本农地流转中的政府角色设计,肯定并重视政府在流转中的主导作用,同时强调引导、培育和服务的职能,加强产业融合,建设现代化农业体系,推动农地流转"依法、自愿、有偿"进行。
[Abstract]:Generally speaking, under the private ownership of property, land as a farmer's property can be freely transferred in the market. However, in view of the natural and economic and social attributes of agricultural land, the transfer of agricultural land has great externalities. The transfer of agricultural land is not a complete market transaction, but needs government regulation and guidance. After the war, Japan established private ownership of land and strictly controlled the circulation of agricultural land through the system design of circulation permit, contract control, tenancy quota, etc. With the development of economy, The conditions for land transfer control have been gradually relaxed, and the Japanese government has moved from a single regulator to a guide. However, this transformation only reflects the "prudent easing" and does not change the foundation and nature of the construction of the agricultural land circulation control system in Japan. Nor has it shaken the leading position of the Japanese government in the transfer of agricultural land. When China vigorously promotes the transfer and scale management of agricultural land, it can refer to the design of the role of the government in the transfer of agricultural land in Japan, and affirm and attach importance to the leading role of the government in the transfer of agricultural land. At the same time, it emphasizes the functions of guidance, cultivation and service, strengthens the integration of industry, builds up the modern agricultural system, and promotes the agricultural land circulation "according to law, voluntarily and paid".
