食品安全溯源法律制度探讨

【摘要】：食品安全是当前我国社会关注的热门话题，而食品安全溯源制度是食品安全保障体系的重要制度之一。它是一种食品安全信息披露工具，既可以施行有效监管又可以找到安全问题的出处，减少食品安全问题的发生，有效地保证食品安全，对促进食品安全保障体系的完善具有非常重要的意义。在食品安全溯源的立法领域，发达国家走在了世界的前列，值得世界各国学习和借鉴。当中，有两种最具代表性的法律模式即欧盟模式和美国模式。目前，我国的食品安全法律制度建设尚存在不足，应当借鉴欧盟和美国等发达国家的成功经验来完善我国现行的食品安全溯源法律制度。本文共分三大章节，第一章是“食品安全溯源发展沿革及其法律规制现况考察”，对发达国家和我国的食品安全溯源的发展沿革进行简要介绍，分析了我国食品安全溯源法律规制的现状及其存在的问题；第二章是“发达国家食品安全溯源法律制度模式及其启示”重点介绍发达国家食品安全溯源法律制度的两种主要代表模式即欧盟模式和美国模式，并对其特点进行分析，，试图借鉴发达国家食品安全溯源制度的有益的立法经验及先进做法，为完善我国食品安全溯源法律制度提供思路；第三章是“完善我国食品安全溯源法律制度的思考”，阐述了作者完善我国食品安全溯源法律制度的基本思路，为完善我国食品安全溯源法律制度的设计出谋划策。
[Abstract]:Food safety is a hot topic of social concern in our country, and food safety traceability system is one of the important systems of food safety guarantee system. It is a food safety information disclosure tool. It can not only carry out effective supervision, but also find the source of safety problems, reduce the occurrence of food safety problems, and effectively ensure food safety. It is of great significance to promote the improvement of food security system. In the legislative field of food safety traceability, developed countries are at the forefront of the world and are worthy of learning and learning from them. There are two most representative legal models, namely, the EU model and the US model. At present, there are still deficiencies in the construction of the food safety legal system in China. The successful experiences of developed countries such as EU and USA should be used for reference to perfect the current food safety traceability legal system in China. This paper is divided into three chapters, the first chapter is "food safety traceability development and legal regulation review", the development of food safety traceability in developed countries and China are briefly introduced. The current situation and existing problems of traceability of food safety in China are analyzed. The second chapter is "developed country food safety traceability legal system model and its enlightenment", mainly introduces the developed country food safety traceability legal system two main representative models, namely the European Union model and the American model, and carries on the analysis to its characteristic. This paper attempts to draw lessons from the beneficial legislative experience and advanced practices of the traceability system of food safety in developed countries in order to provide ideas for perfecting the traceability legal system of food safety in China. The third chapter is the thinking of perfecting the traceability legal system of food safety in our country. The author expounds the basic ideas of perfecting the legal system of traceability of food safety in China, and makes some suggestions for the design of the legal system of traceability of food safety in China.
