高职院校顶岗实习生权益保护的研究

【摘要】:“顶岗实习”是伴随着我国社会、经济发展的需要,在高等职业教育发展和改革的过程中而提出的概念,是对职业教育体制的一种创新。“顶岗实习”已成为高等职业教育的主导人才培养模式。在学生进行顶岗实习的过程中,学生的法律权益保障也成为一个亟待需要解决的问题。本文从我国关于高职学生顶岗实习权益保护的基础出发,分析了高等职业院校、顶岗实习生以及实习单位三者之间的法律关系,从而进一步明确顶岗实习生的法律身份以及高等职业院校在保护顶岗实习学生中应尽的义务,指出了我国高职院校学生顶岗实习方面存在的诸多问题:如目前的法律保障问题,缺乏专门的顶岗实习法律制度;学院本身对于顶岗实习生的管理制度方面存在的问题,每个高等职业院校都会在《学生手册》中制订相应的管理规定,基本上都是对于学生在实习期间的约束和要求,而对于顶岗实习生在实习期间所出现的权益保护问题,都没有提及;作为顶岗实习的学生一旦出现劳动报酬、劳动时间、意外伤害等给其带来的的纠纷问题,学生、实习单位、高等职业院校三方都比较尴尬,这也给执法部门带来一定的难度,对学生维权造成了一定困扰的问题;职业院校对学生实习前以及实习过程中缺乏必要的维权教育等问题。因此,本文从高职院校的角度出发,针对在具体实践操作中对高职学生顶岗实习权益保障不足,致使学生往往处于相对弱势的地位,法律权益得不到有效的保障的问题,强调了在学生顶岗实习的过程中,高职院校应起到的作用:即从签订完善的实习协议来弥补法律制度的缺失问题,从而进一步明确各方的权责;制定配套的实习管理规定,对于学生可能出现的各类问题予以明确;加强对于学生的思想教育,提高学生的法律意识,使学生懂得用法律手段维护自身的合法权益;此外,选择好实习保险,实现实习责任社会化,减轻高职院校和实习单位的压力,进一步推进高等职业院校顶岗实习工作的开展,为社会提供更多优秀的高素质、技能型职业人才,促进我国社会、经济的深入发展。
[Abstract]:With the needs of the social and economic development of our country, the concept of "on-the-job internship" is put forward in the course of the development and reform of higher vocational education. It is a kind of innovation to the vocational education system. "practice on the job" has become the leading talent training mode of higher vocational education. The protection of students' legal rights and interests has become an urgent problem to be solved. The legal relationship between the intern and the internship unit, so as to further clarify the legal status of the intern and the obligations that higher vocational colleges should play in protecting the internship students. This paper points out that there are many problems in the practice of the students in higher vocational colleges in our country, such as the current legal guarantee, the lack of a special legal system for the internship, the problems in the management system of the interns in the colleges themselves. Each higher vocational college will formulate corresponding management regulations in the Student Handbook, basically for the constraints and requirements of the students during the internship period, and for the protection of the rights and interests of the post-graduate interns during the internship period. No mention has been made of this; once students who are on the job have disputes brought about by remuneration, working hours, accidental injuries, etc., students, internship units, and higher vocational colleges are all relatively embarrassed. This also brings some difficulties to the law enforcement departments, and causes some puzzling problems to the students' rights protection; the vocational colleges lack the necessary rights education before and during the practice. Therefore, from the point of view of the higher vocational colleges, this paper starts from the point of view of the higher vocational colleges. In view of the problem that the rights and interests of higher vocational college students are not protected enough in practical operation, students are often in a relatively weak position and their legal rights and interests are not effectively protected, the paper emphasizes that in the process of students' practice, The role that higher vocational colleges should play is to make up for the lack of the legal system by signing perfect practice agreements, so as to further clarify the rights and responsibilities of all parties. To clarify the various problems that may arise among students; to strengthen ideological education for students, to enhance students' legal awareness, and to enable students to protect their legitimate rights and interests through legal means; in addition, to choose a good internship insurance. To realize the socialization of practice responsibility, to lighten the pressure of higher vocational colleges and practice units, to further promote the development of job placement practice in higher vocational colleges, to provide more excellent and skilled professional talents for the society, and to promote our society, The deep development of the economy.
