权利与秩序:大学生纪律处分的司法救助机制研究

【摘要】：高校对大学生纪律处分权源自国家法律授权与行政授权、家长的契约委托与高校独立的事业单位法人身份。因此,高校对学生的纪律处分既具有"公行政"与"私行政"的双重法律性质,也属于"委托管理行为"。优化对大学生纪律处分的司法救助机制需要厘定"公行政"行为的范围,划定司法介入的限度;按照"行政救济优先"的原则,强化司法救济的程序建设;建立专职教育司法机构,提升司法救助的效率。
[Abstract]:On College Students' disciplinary powers from the authorization of state laws and administrative authority, legal institutions and universities contracting parents separate identity. Therefore, college students' disciplinary has the dual legal nature of public administration "and" private administration ", also belong to the" entrusted management behavior ". The scope of optimization of college students the disciplinary judicial relief mechanism to formulate the" public administration "behavior, limit delineation of judicial intervention; in accordance with the" administrative relief priority "principle, strengthen the judicial procedure construction; establish professional judiciary education, improve the efficiency of judicial relief.
