【摘要】：食品安全问题近年来在我国屡见报端，是我国当前被社会大众所热议的焦点问题。食品安全与老百姓的生活息息相关，自古以来就有民以食为天的俗语，同时食品安全也是我国实现经济社会可持续发展的重要基础，没有良好的食品安全环境将会对我国的食品经济、进出口贸易、社会稳定等一系列发展战略问题产生重大影响。经过改革开放三十多年来的迅猛发展我国经济社会已经取得了翻天覆地的变化，同时在高速发展中也出现了新问题如当前温饱已不再是我国人民群众所关心的唯一问题，人民有了新的期待有了更高的追求，就是吃的安全吃的健康。然而，屡屡发生的食品安全问题却让人民群众对我国的食品安全状况产生怀疑和恐惧，食品安全已经影响到了我国的经济社会发展与进步。本文从食品安全法律规制的角度来探索破解我国食品安全难题的路子，通过学习研究西方发达国家例如欧盟以及美国等的食品安全法律规制发展历程，吸取其科学成熟的经验做法，结合我国实际，，来探索出一条适合我国国情的破解食品安全重大课题的路子，为我国食品安全工作的科学有效开展提供些许建议。文章第一章导论从选题的意义、国内外研究现状、研究内容和方法写起。第二章从食品安全法律规制基本概念入手，阐明了食品安全和食品安全法律规制的基本定义然后又说明了食品安全法律规制对于做好当前我国食品安全工作的必要性，有两方面一是我国客观的食品安全环境、二是食品安全的自身特点。第三章客观评述了我国食品安全法律规制的现状从立法现状和执法现状两个角度来谈。第四章分析了我国食品安全法律规制存在的主要问题，有食品安全法律规制的立法缺陷和食品安全法律执行不力的问题。第五章学习研究了国外欧盟及美国的食品安全法律规制状况并从中总结了几点启示，启示有一是加强食品安全法律体系建设、二是提高食品安全的监管能力。第六章是本文的重点内容主要是从完善我国食品安全法律规制的思考来谈应从相应制度和原则层面提高我国的食品安全法律规制水平。食品安全问题是全世界都高度重视的话题，是社会经济发展历程中都要面对的问题，毋庸置疑食品安全问题是个复杂的社会问题,不是一蹴而就的，也不是一劳永逸的，需要政府做好相应规划和监管工作也需要全社会的共同关注与努力。做好食品安全工作我们任重而道远，然而作为一个法治国家，从法律规制层面做好食品安全工作应是重中之重和治本之策，这也是本文的写作意义所在。
[Abstract]:In recent years, the issue of food safety has been frequently reported in our country, which is the focus of discussion by the public.Food safety is closely related to the daily life of the common people. Since ancient times, there has been a saying that people take food as the sky. At the same time, food safety is also an important basis for the sustainable economic and social development of our country.The absence of a good food safety environment will have a significant impact on China's food economy, import and export trade, social stability and a series of development strategies.After more than 30 years of reform and opening up, the rapid development of our country's economy and society has made earth-shaking changes. At the same time, in the course of rapid development, new problems have emerged, such as food and clothing are no longer the only problems of concern to the people of our country.People have new expectations and higher aspirations, that is, eat safely and eat healthy.However, the frequent food safety problems have caused people to have doubts and fears about the food safety of our country. Food safety has affected the economic and social development and progress of our country.This paper explores the ways to solve the food safety problems in China from the perspective of food safety laws and regulations, and studies the development course of food safety legal regulation in western developed countries, such as the European Union and the United States.Drawing on its scientific mature experience and practice and combining with the reality of our country, this paper explores a way to solve the major problem of food safety, which is suitable for the national conditions of our country, and provides some suggestions for the scientific and effective development of food safety work in our country.The first chapter introduces the significance of the topic, domestic and foreign research status, research content and methods.The second chapter starts with the basic concept of food safety legal regulation, clarifies the basic definition of food safety and food safety legal regulation, and then explains the necessity of food safety legal regulation to do well the current food safety work in our country.There are two aspects, one is the objective food safety environment, the other is the characteristics of food safety.The third chapter objectively comments on the current situation of food safety legal regulation in China from the two angles of legislation and law enforcement.The fourth chapter analyzes the main problems existing in the legal regulation of food safety in China, including the legislative defects of the legal regulation of food safety and the lack of enforcement of the law on food safety.The fifth chapter studies the situation of food safety legal regulation in foreign European Union and America and summarizes some enlightenments, one is to strengthen the construction of food safety legal system, the other is to improve the ability of food safety supervision.The sixth chapter is the main content of this paper, mainly from the thinking of perfecting the food safety legal regulation in our country to talk about how to improve the level of the food safety legal regulation in our country from the corresponding system and principle level.The issue of food safety is a topic that the whole world attaches great importance to and is a problem to be faced in the course of social and economic development. There is no doubt that the issue of food safety is a complex social issue, which is not achieved overnight or once and for all.Need the government to do the corresponding planning and supervision work also need the common attention and efforts of the whole society.We have a long way to go to do a good job in food safety. However, as a country ruled by law, it should be the most important and fundamental strategy to do food safety work from the level of legal regulation, which is also the significance of this paper.
