论《基本医疗卫生法》的名称、定位与基本制度

【摘要】：我国《基本医疗卫生法》已经被提上了立法日程,但立法过程中还有诸多理论问题亟待解决。相比于《基本医疗卫生法》等法名,《基本卫生法》或《卫生法》是更为科学而规范的名称。《基本医疗卫生法》的立法定位是承担着基本医疗服务保障功能的一部卫生基本法。作为我国卫生领域的基本法,《基本医疗卫生法》应当规定医疗保健基本制度、药品管理基本制度、公共卫生保障制度、卫生科技与卫生教育促进及规范基本制度。
[Abstract]:China's basic Medical and Health Law has been put on the legislative agenda, but there are still many theoretical problems to be solved.Compared with the basic Medical and Health Law, the basic Health Law or the Health Law is a more scientific and standardized name. The legislative orientation of the basic Medical and Health Law is a basic law of health care which bears the function of guaranteeing the basic medical services.As the basic law in the field of health care in China, the basic Medical and Health Law should stipulate the basic system of medical and health care, the basic system of drug administration, the system of public health security, the promotion and standardization of basic system of health science, technology and health education.
