合作性劳动关系法律调整研究

【摘要】:当前,我国正处于经济社会转型时期,劳动关系的主体及其利益诉求越来越多元化,劳动关系矛盾也已进入凸显期和多发期。劳动关系也随着经济体制改革的进一步深化,更为灵活、更富弹性就业模式的逐渐兴起,而有了新的发展。吸收劳动者参与到公司、企业的管理运行中事实上都已出现且并不少见,相关法律制度中也确立了劳动者参与用人单位运营决策的各种模式。就实践结果来看,劳动者加入到用人单位的运营决策,对整体组织效益的增长有着不容忽视的影响,然而现实是,劳动者诸多的合法权益的保护尚有不足甚至缺失,并缺乏救济合法权益的有效途径。本文认为当前劳动关系的合作性日益凸显,其核心在于实现劳动者对企业管理的有效参与。我国现有的职工代表大会制度,职工董事、职工监事制度以及职工持股制度等,都是对合作性劳动关系进行法律调整的初步体现。接着结合英美法系、大陆法系的代表性国家,美、英、德、日四国的法律规范现状,概括出西方国家劳动关系合作性的法律调整现状对我国的启示。然后结合我国相关法律调整现状的不足,认为主要存在劳动关系涵义认定不清晰,职工持股制度立法缺位以及现有调整劳动关系合作性的诸多法律制度虚化等问题。最后,提出明晰劳动关系涵义的建议,并对于我国劳动关系合作性相关法律制度的完善,具体结合职工持股制度,职工董事、监事制度和职工代表大会制度,提供一些探索路径,期望对我国良性合作性劳动关系的构建有所助益。
[Abstract]:At present, our country is in the period of economic and social transformation, the main body of labor relations and its interest demands are more and more diversified, the contradiction of labor relations has also entered the prominent period and the frequent period.With the deepening of the reform of economic system, the employment mode of labor relations is more flexible and more flexible, and has a new development.Absorbing workers to participate in the company, the management and operation of enterprises have in fact appeared and are not uncommon, the relevant legal system has also established a variety of models of workers participating in the decision-making of employers' operation.As far as practical results are concerned, the participation of workers in the operational decisions of employing units has a significant impact on the growth of overall organizational benefits. However, the reality is that the protection of many legitimate rights and interests of workers is still inadequate or even lacking.And the lack of effective ways to remedy the legitimate rights and interests.This paper argues that the cooperative nature of labor relations is increasingly prominent, the core of which is to realize the effective participation of laborers in the management of enterprises.The existing system of workers' Congress, staff directors, staff supervisors and employee stock ownership system are the preliminary embodiment of the legal adjustment of cooperative labor relations.Then combined with the representative countries of Anglo-American law system, continental law system, the United States, Britain, Germany, Japan four countries of the legal norms, summed up the western countries labor relations cooperative legal adjustment of the current situation of China's enlightenment.Then combined with the deficiency of the relevant legal adjustment in our country, the author thinks that there are some problems such as the definition of labor relations is not clear, the legislation of employee stock ownership system is absent, and the existing legal system of adjusting labor relations cooperation is empty, and so on.Finally, some suggestions are put forward to clarify the meaning of labor relations, and to perfect the related legal system of labor relations cooperation in China, specifically combining the system of employee stock ownership, the system of employee directors, supervisors and the system of workers' Congress.To provide some ways to explore the construction of benign cooperative labor relations in China.
