农民留种权的国外立法及其借鉴

【摘要】：本文考察了美国、欧盟及印度3个国家和地区农民留种权的立法实践,分析了农民留种权的具体制度构成,并评析了当前农民留种权的立法趋势。在此基础上,依据中国农民留种权的立法现状,提出了完善中国农民留种权的立法建议。
[Abstract]:This paper examines the legislative practice of farmers' right to seed retention in three countries and regions of the United States, the European Union and India, analyzes the constitution of the specific system of farmers' right to seed retention, and evaluates the current legislative trend of farmers' right to seed retention. On this basis, according to the current situation of Chinese farmers' right of seed retention, the author puts forward some legislative suggestions to perfect the right of Chinese farmers' right of seed retention.
