论我国行政监察制度存在的问题及完善

【摘要】：行政监察制度是各国政治体制中的重要组成部分,对维护公民合法权益、促进政府权力的规范运行等方面具有不可替代的作用,在国家的行政活动中具有重要的地位。中华人民共和国成立以来,我国的行政监察制度经过创建、停滞和重建完善等发展阶段,逐步形成了一套比较健全的行政监察法律体系,在查办案件、开展专项监察等方面取得了举世瞩目的成果,促进了依法行政建设。但随着行政权力在现实政治生活中的不断拓展,行政监察制度存在的缺点和不足越来越突出,表现在行政监察法律法规不健全、行政监察机关缺乏独立性和权限范围过窄、监察人员素质有待提高等方面。反观相关国家和地区,如美国、新加坡、日本和我国香港特区等,都有完善的行政监察制度,行政监察作用也得到了很好地发挥,这启示我们借鉴其成功经验,在以下四个方面对我国的行政监察制度进行完善：一是制定完备的行政监察法律体系,二是设立拥有独立地位的行政监察机关,三是赋予监察机关广泛的权力,四是提高监察人员的素质,并为其提供优厚的物质保障。进一步加强和改进我国的行政监察工作,以推动社会主义政治文明的建设。
[Abstract]:The administrative supervision system is an important part of the political system of various countries. It has an irreplaceable role in maintaining the legitimate rights and interests of the citizens and promoting the standardized operation of the government power. It has an important position in the administrative activities of the state. Since the founding of People's Republic of China, the administrative supervision system of our country has been established, stagnated and heavy. To build a perfect stage of development, a set of more sound administrative supervision legal system has been gradually formed, which has made remarkable achievements in investigating cases and carrying out special supervision, and promoted the construction of administration according to law. However, with the continuous expansion of administrative power in the real political life, the shortcomings and shortcomings of the administrative supervision system are becoming more and more important. The more outstanding, the administrative supervision laws and regulations are not perfect, the administrative supervision organs lack the independence and the scope of authority too narrow, and the quality of the inspectors need to be improved. In addition, the relevant countries and regions, such as the United States, Singapore, Japan and the Hongkong Special Economic Zone, have a perfect administrative supervision system, and the role of administrative supervision has also been very good. As a result, we can learn from its successful experience and improve our administrative supervision system in the following four aspects: one is to establish a complete legal system of administrative supervision, the two is to set up an administrative supervisory organ with independent status, the three is to endow the supervisory authority with extensive power, and the four is to improve the quality of the inspectors and to provide them for it. It provides a good material guarantee, and further strengthens and improves our administrative supervision so as to promote the construction of socialist political civilization.
