【摘要】：“郭门临渡头,村树连溪口。白水明田外,碧峰出山头。”王维的这首《新晴野》给我们描绘了一幅精美的田园生活画面,流水潺潺,碧水出山。可在田边戏雨燕,可取流水备三餐。然而,这种和谐的生活风貌也只能是出现在这美好的诗句中了,留给我们无尽的遐想。随着社会的发展,后工业时代的到来以及逆城市化的崭露头角,农村地区的生态环境正日益恶化:曾经的大河蜕变成小溪,曾经的小溪却不复存在。工业污染的魔爪伸向农村,带来的废水、废渣随意排放;农民的环保意识也没能跟得上生活水平的提高速度;大量的农药化肥使用非但收不到先前的效果,反使得土地和湖水河流受到了毒害,至鱼虾不见了踪影。最让人心痛的是不少地区农民的喝水也成了问题。农村地区的饮用水安全正给我们敲响了警钟,因此,如何运用法律政策手段对农村饮用水源地的建设保护提供指导成为当务之急。本文将从六个方面着手写作,详细论述一下我国农村地区饮用水源地建设保护的法律制度。第一部分为“引言”,介绍一下本文选题的背景和意义、研究方法和目前国内外的研究现状,为下一步写作奠定基础。第二部分为“我国农村饮用水源地法律制度概况”,对我国农村地区饮用水源地的面临的窘迫境地及保护的必要性展开论述,指出进行农村饮用水源地法律制度完善势在必行。第三部分为“我国农村地区饮用水源地法律制度的现状及瓶颈”,文中着重介绍我国法律制度在关于农村饮用水源地方面的具体规定以及所存在的不足,找到病因,好为下一步对症下药打好基础。第四部分“国外饮用水源地法律制度的考察”,从世界其他国家借鉴一下他们在应对饮用水源地的危机时如何处理、如何平稳的渡过难关,取别人之长为我所用。第五部分是“我国农村饮用水源地法律制度的完善”,根据以上分析和借鉴,提出我国农村饮用水源地的建设保护方面还有哪些需要解决的问题,以及展望未来的美好成果。最后为“结语”部分,进一步阐述自己的论点结论,并反思自己的不足之处。
[Abstract]:Guo Men adjoins the Dutou, and the village trees connect with the stream mouth. White water Ming Tian outside, Bifeng out of the mountain. " Wang Wei's "Xinqing Wild" depicts us a beautiful picture of pastoral life, water gurgling, clear water out of the mountains. You can play Swift at the edge of the field, you can prepare three meals with running water. However, this harmonious life style can only appear in this beautiful poem, leaving us endless reverie. With the development of society, the arrival of post-industrial era and the emergence of counter-urbanization, the ecological environment in rural areas is deteriorating day by day: once the big river degenerated into a stream, but once the stream no longer exists. The clutches of industrial pollution extend to the rural areas, resulting in the free discharge of waste water and waste residue; farmers' awareness of environmental protection has not been able to keep pace with the improvement of living standards; and the use of a large number of pesticides and fertilizers has not been able to achieve the previous effect. Instead, the land and lakes and rivers were poisoned to the point where the fish and shrimp disappeared. The most heartache is that many farmers in many areas also have problems drinking water. Drinking water safety in rural areas is sounding the alarm bell for us. Therefore, how to use legal and policy means to provide guidance for the construction and protection of rural drinking water sources has become an urgent task. This paper discusses the legal system of the construction and protection of drinking water sources in rural areas of our country from six aspects. The first part is "introduction", which introduces the background and significance of this thesis, the research methods and the current research situation at home and abroad, laying a foundation for the next step of writing. The second part is "Overview of the legal system of drinking water sources in rural areas of China", which discusses the difficult situation and the necessity of protection of drinking water sources in rural areas, and points out that it is imperative to perfect the legal system of drinking water sources in rural areas. The third part is "the present situation and the bottleneck of the drinking water source legal system in rural areas of our country", the article emphatically introduces the specific regulation and the deficiency of the rural drinking water source area of our country legal system, and finds out the cause of the disease. Good for the next step to the right medicine to lay a good foundation. The fourth part "the investigation of the legal system of the drinking water source in foreign countries", draw lessons from other countries in the world how to deal with the crisis of drinking water source, how to smoothly tide over the difficulties, take the growth of others for our use. The fifth part is "the consummation of the legal system of the rural drinking water source in our country". According to the above analysis and reference, the author puts forward some problems that need to be solved in the construction and protection of the rural drinking water source in our country, and looks forward to the good results in the future. The last part is the conclusion of the thesis, and reflects on its shortcomings.
