论劳动法上的强制性规范

【摘要】:通过对现行劳动法的分析,我们发现由于法律的局限性,我国的劳动法并不能全面的将劳动者的利益纳为强制性规范的范围内,劳动法的真实效应也未能充分得到发挥,其原因主要在于我国的劳动法在实际使用过程中常常因为不能清楚区分强制性规范、公共政策条款、自我限定规范的界限因而出现了混用的现象。想要解决这一问题,理清劳动者与劳动者权利的关系就必须充分分析劳动法体系系统,深刻认识强制性规范的含义。从这一角度出发,本篇文章首先从概念上对强制性规范概念进行了分析,其次对劳动法上强制性规范规定的必要性进行了分析同时对劳动法上的强制性规范做出了解释,旨在理清三者之间的关系为增强劳动法的适用性做出贡献。
[Abstract]:Through the analysis of the current labor law, we find that because of the limitation of the law, the labor law of our country can not fully accept the interests of the laborer as the compulsory norm, and the true effect of the labor law can not be brought into full play. The main reason lies in the fact that the labor law in our country is often used in the process of being unable to distinguish between the mandatory norms clearly, the public policy clauses and the limits of self-limiting norms have appeared the phenomenon of mixed use. In order to solve this problem, it is necessary to analyze the system of labor law and understand the meaning of mandatory norms. From this point of view, this article firstly analyzes the concept of mandatory norms from the concept, then analyzes the necessity of the mandatory norms in the labor law and explains the mandatory norms in the labor law. The aim is to clarify the relationship between the three to enhance the applicability of labor law.
