内蒙古自治区阿拉善盟综合行政执法改革的法律问题分析

【摘要】：在全面深化改革的背景下,党的十八届三中、四中全会就深化行政执法体制改革提出具体的改革方向,通过整合执法主体,推进综合执法,减少行政执法层级等举措,进一步加快政府机构整合、减少多头执法、从而提高行政执法效率。在国内大部制改革的思路下,综合行政执法改革在深圳、上海、浙江等地自2009年起已陆续展开了综合行政执法改革的实践与探索,目前大致体现在以下几个方面:一方面需要推行部门内部综合执法,整合执法主体;一方面需要推进跨部门、跨领域综合执法;一方面需要压缩行政层级,加强市县两级政府的统一领导和协调。阿拉善盟开展的综合行政执法改革实践由多项改革综合而成,在市场监督、文化旅游、农牧业、城市管理等领域和部门同时开展了多方面的改革试点工作,满足了对综合行政执法改革各个方面的探索需求,对其他地方政府提供了重要的参考价值。本文研究的目的就是从阿拉善盟综合行政执法改革的几个实践方向出发,研究阿拉善行政综合执法改革所取得的进展、存在的问题,在这个基础上,对问题原因进行深入分析,提出可行的对策。本文第一部分对内蒙古阿拉善盟综合行政执法改革的现状进行分析,包括改革概况、阿拉善盟改革进展、和阿拉善盟改革成效;第二部分由改革带来的问题和原因分析,包括阿拉善盟改革中存在的问题和这些问题产生原因的分析;第三部分对改革的完善对策进行探讨,包括完善法律体系及制度程序、多种改革方向并行推进改革、加强综合行政执法融合性、探索跨行政区域的行政执法形式几方面的探讨。
[Abstract]:In the context of comprehensive deepening of the reform, the fourth Plenary session of the 18th CPC Central Committee put forward specific reform directions for deepening the reform of the administrative law enforcement system, by integrating the main body of law enforcement, promoting comprehensive law enforcement, and reducing administrative law enforcement levels, and so on. Further speed up the integration of government agencies, reduce the number of law enforcement, thereby improving the efficiency of administrative law enforcement. Under the train of thought of domestic large-scale reform, comprehensive administrative law enforcement reform has been carried out in Shenzhen, Shanghai, Zhejiang and other places since 2009, the practice and exploration of comprehensive administrative law enforcement reform has been carried out one after another since 2009. At present, it is generally reflected in the following aspects: on the one hand, it is necessary to implement comprehensive law enforcement within the departments and integrate the law enforcement bodies; on the other hand, it needs to promote comprehensive law enforcement across departments and fields; on the other hand, it needs to reduce the administrative levels. Strengthen the unified leadership and coordination of the municipal and county levels of government. The practice of comprehensive administrative law enforcement reform carried out by Alashan League consists of a number of reforms. Pilot reform work has been carried out in various fields and departments such as market supervision, cultural tourism, agriculture and animal husbandry, urban management, etc. It meets the needs of all aspects of comprehensive administrative law enforcement reform and provides important reference value to other local governments. The purpose of this paper is to study the progress and problems in the reform of comprehensive administrative law enforcement in Alashan League from several practical directions. On this basis, the causes of the problems are deeply analyzed. Put forward feasible countermeasure. The first part of this paper analyzes the current situation of the comprehensive administrative law enforcement reform of the Alashan League in Inner Mongolia, including the general situation of the reform, the progress of the reform of the Alashan League, and the results of the reform of the Alashan League; the second part analyzes the problems and causes brought about by the reform. Including the problems in the reform of Alashan League and the analysis of the causes of these problems. The third part discusses the countermeasures to improve the reform, including perfecting the legal system and system procedures, advancing the reform in parallel with various reform directions. Strengthen the integration of comprehensive administrative law enforcement and explore several aspects of administrative law enforcement form across administrative regions.
