以制定大学章程为契机全面推进依法治校

【摘要】：大学自治、学术自由和权益保障是现代大学的三大基本特征。大学章程是大学的"宪法",是现代大学制度的基石,是依法治校的制度保障。依法治校要求政府及其工作人员树立权力边界意识和执法程序意识,保障大学自治;要求学校实现学术权力与行政权力的相对分离,保障教师和学生的研究自由、学习自由和学术自由;切实通过教职工代表大会、学生会等组织,保障师生的知情权、参与权、表达权和监督权;健全校内权利救济和纠纷解决机制,运用法治思维和法律手段解决学校与教师、学校与学生的矛盾及纠纷。
[Abstract]:University autonomy, academic freedom and protection of rights and interests are the three basic characteristics of modern universities. The constitution of the university is the constitution of the university, the cornerstone of the modern university system and the guarantee of running the university according to law. Governing a school according to law requires the government and its staff to establish a sense of power boundary and awareness of law enforcement procedures, to ensure university autonomy, to ensure the relative separation of academic and administrative powers, and to ensure the freedom of research for teachers and students. Freedom of learning and academic freedom; ensuring the right of teachers and students to know, participate in, express and supervise, through staff and staff congresses and student union organizations; and improving the mechanism for relief of rights and dispute resolution in schools, Using the rule of law thinking and legal means to solve the school and teachers, schools and students of contradictions and disputes.
