完善我国劳动争议诉前处理机制研究

【摘要】:近年来,随着市场经济体系的不断完善和企业改革力度的加大,激化了劳资矛盾,使大量的劳动争议纠纷涌入劳动仲裁机构和人民法院,形成了案件积压,不利于很好保护劳动者利益,由此使处理劳动争议任务日益艰巨,劳资双方积怨加深,进而使我国劳动争议处理机制与市场经济运行规则不适应状况日益明显。 自2008年5月1日《中华人民共和国劳动争议调解仲裁法》施行以来,劳动争议处理机制已基本形成为协商、调解、仲裁、诉讼的模式,且得到法律确认,新法律在保持原模式基本不变的基础上,完善和明确了一些争议较多的具体制度,但新法出台前后处理劳动争议案件在程序上没有明显改变,尤其是关于劳动争议诉前处理机制的规定没有明显改进,进而劳动者维权难的状况依然存在。如何进一步完善我国劳动争议诉前处理机制,更好的保护劳动者利益,需要提上新议程。现今,正处经济、社会转型期,要充分站在劳动者角度,考虑劳资双方出发点,出台相关制度,并采取合法高效的程序,尽可能快速化解劳资矛盾,引导劳动关系走上健康有序的经济发展轨道。 本文共分四部分:第一部分,我国劳动争议诉前处理机制阐释。其中涉及劳动争议诉前处理机制的界定及其历史发展,并阐述诉前处理机制的方式和优势。第二部分,通过介绍发达国家和地区劳动争议诉前处理制度,从中学到适合我国国情的做法。其中主要通过对美国、法国、日本、德国等国家诉前处理机制进行分析比较,总结其中合理、高效的规定,得出对我国相关制度建设的借鉴意义。第三部分,通过对我国现行劳动争议诉前处理机制运行状况分析研究,找出其中存在的弊端,即:调解、仲裁形同虚设;仲裁前置,途径单一;各种解决机制之间关系不畅,资源重复浪费;仲裁时限受限等。第四部分,针对我国劳动争议诉前处理机制存在的弊端,提出完善建议,其中第四部分完善我国劳动争议诉前处理机制研究为重点。
[Abstract]:In recent years, with the continuous improvement of the market economy system and the intensification of the enterprise reform, the contradiction between labor and capital has been intensified, and a large number of labor dispute disputes have poured into labor arbitration institutions and people's courts, forming a backlog of cases. It is not conducive to the protection of the interests of workers, which makes the task of handling labor disputes increasingly arduous, and the accumulated grievances between employers and employees deepen, thus making it increasingly obvious that the mechanism of handling labor disputes in China does not adapt to the operating rules of the market economy. Since the implementation of the Labor dispute Mediation and Arbitration Law of the people's Republic of China on May 1, 2008, the labor dispute settlement mechanism has basically formed into a mode of consultation, mediation, arbitration and litigation, and has been confirmed by law. On the basis of keeping the original model basically unchanged, the new law has perfected and clarified some specific systems which are more controversial, but the procedures for handling labor dispute cases before and after the enactment of the new law have not changed significantly. Especially, there is no obvious improvement on the regulation of labor dispute pre-litigation mechanism, and the problem of laborer's rights protection is still in existence. It is necessary to put forward a new agenda on how to further improve the mechanism of handling labor disputes before litigation and better protect the interests of laborers. Now, in the current economic and social transition period, we should fully stand on the workers' point of view, consider the starting point of both employers and employees, introduce relevant systems, and adopt legal and efficient procedures to resolve labour conflicts as quickly as possible. Guide labor relations to a healthy and orderly economic development track. This article is divided into four parts: the first part, China labor dispute pre-litigation mechanism explanation. It involves the definition and historical development of labor dispute pre-action mechanism, and expounds the way and advantage of labor dispute pre-action mechanism. In the second part, the author introduces the system of labor dispute pre-action in developed countries and regions, and learns some methods suitable for our country. Through the analysis and comparison of the pre-litigation mechanism of the United States, France, Japan, Germany and other countries, this paper summarizes the reasonable and efficient provisions, and draws the reference significance for the construction of relevant systems in China. The third part, through the analysis and research on the operation of the current labor dispute pre-litigation mechanism in our country, finds out the disadvantages, that is, mediation, arbitration is virtual, the arbitration is ahead, the way is single, and the relationship between various settlement mechanisms is not smooth. Repeated waste of resources; limitation of time limit for arbitration, etc. In the fourth part, the author puts forward some suggestions for the improvement of the mechanism of labor dispute pre-action in our country, and the fourth part focuses on the research of the mechanism of the pre-action of labor dispute in our country.
