基本医疗卫生立法忌思想僵化——评“卫生立法需直面五个矛盾”

【摘要】：实证表明,把"免费医疗制度"戴上"西方的"帽子,是思想僵化的表现。在现代社会,一国是否实行"全民免费医疗制度",主要取决于该国的政治愿意、政治选择和卫生体系的文化传统、公众的就医习惯等因素,与该国所处发展阶段没有必然联系。我国主要经济指标和人类发展指数情况较好,可持续发展指标、法治指标、人权与公众参与指标有大幅提高的空间。建议基本医疗卫生立法从这个实际出发,克服思想僵化,正确处理卫生公平与效率的关系;当两者不能兼得,应贯彻公平优先、兼顾效率原则。为此,要高度重视公民健康决策参与权,通过立法使之得到尊重、保护和实现。
[Abstract]:Empirical evidence shows that putting the free medical system on the "Western" hat is a sign of ideological rigidity. In modern society, whether a country implements a "free health care system for all" mainly depends on its political will, political choices and cultural traditions of the health system, and the public's habit of seeking medical care, which is not necessarily related to the stage of development of the country. China's main economic indicators and human development indicators are good, sustainable development indicators, indicators of the rule of law, human rights and public participation indicators have significant room for improvement. It is suggested that the basic medical and health legislation should proceed from this reality, overcome the ideological ossification and correctly handle the relationship between health fairness and efficiency, and implement the principle of giving priority to equity and efficiency when the two cannot be obtained simultaneously. Therefore, we should attach great importance to citizens' right to participate in health decision making and make it respected, protected and realized through legislation.
