【摘要】：高尔夫行业在我国发展的历史并不长,在海南发展的时间更短,但是已经作为海南六大旅游产品之一,对海南旅游业的发展具有重要意义。球童作为高尔夫球场的一线员工,也是高尔夫球场最重要的组成部分,对高尔夫的发展起着举足轻重的作用,却很少有人关注球童这类群体的劳动权益保护。在近几年,球童与高尔夫公司之间的矛盾开始浮出水面,球童们的劳动权益得不到保障。文章主要对海南高尔夫球童的劳动权益保障方面的问题进行研究,对维护球童的劳动权益,促进整个高尔夫行业的发展有着重要意义。文章分为四个部分。第一部分:海南高尔夫球童的基本概述。对球童的渊源及定义进行了介绍,并从调查得知的海南高尔夫球童的相关情况中概括出球童的群体特征、工作特征,反映了球童的生存状态,强调了球童劳动权益保护的必要性。第二部分:海南高尔夫球童劳动权益保护存在的问题。从劳动法以及社会法的基础上总结出球童劳动权益保护方面存在的问题,主要包括:签订劳动合同的权利被侵害,劳动报酬方面存在的问题,休息休假权得不到保障,社会保险权得不到保障,职业稳定权未受到重视,职业培训权缺失。第三部分:海南高尔夫球童劳动权益保护存在问题的原因分析。主要从高尔夫公司方面、高尔夫行业协会方面、球童自身的原因以及球童劳动权益法治保障等四个方面分析存在问题的原因。第四部分:完善海南高尔夫球童劳动权益保护的建议。本部分先从完善措施的基本原则和基本思路入手,再针对存在的问题提出了可行的建议:具体的法律制度安排;加强政府对海南高尔夫行业的政策扶持;构建球童多渠道表达诉求平台、强化企业社会责任;加强高尔夫行业协会的作用、制定小费的行业规范以及提高海南高尔夫球童自身综合素质。希望这些建议能对高尔夫球童的劳动权益保障方面起到好的推动作用,促进球童与高尔夫公司关系的和谐发展。
[Abstract]:The history of golf development in China is not long, and the development time in Hainan is even shorter. However, as one of the six tourism products in Hainan, golf industry is of great significance to the development of Hainan tourism. Caddie, as the first member of the golf course, is also the most important part of the golf course, which plays an important role in the development of golf, but few people pay attention to the protection of the labor rights and interests of these groups. In recent years, conflicts between caddies and golf companies have surfaced, and caddies' labor rights have not been protected. This paper mainly studies the protection of the labor rights and interests of the golf children in Hainan, which is of great significance to safeguard the labor rights and interests of the caddies and to promote the development of the whole golf industry. The article is divided into four parts. The first part: the basic outline of Hainan Golf Boy. This paper introduces the origin and definition of caddies, and summarizes the group characteristics and working characteristics of caddies from the relevant situation of Hainan golf children, which reflects the living state of caddies. The necessity of protecting caddie's labor rights and interests is emphasized. The second part: the problems in the protection of the labor rights and interests of golf children in Hainan. On the basis of labor law and social law, the problems in the protection of caddie's labor rights and interests are summarized, including: the right to sign labor contract is infringed, the problem of labor remuneration, the right to rest and leave is not guaranteed, The right to social security is not guaranteed, the right to occupational stability is not taken seriously, and the right to vocational training is lacking. The third part: Hainan golf children labor rights and interests protection problems analysis. Mainly from the golf company aspect, the golf profession association aspect, the caddie own reason and the caddie labor rights and interests legal protection and so on four aspects analyzes the existence question reason. The fourth part: the suggestion of perfecting the labor rights and interests protection of golf children in Hainan. This part starts with the basic principles and basic ideas of perfecting measures, and then puts forward some feasible suggestions for the existing problems: concrete legal system arrangement, strengthening government policy support to Hainan golf industry; To build a platform for caddies to express their demands through multiple channels, to strengthen corporate social responsibility, to strengthen the role of golf industry associations, to formulate industry norms for tipping, and to improve the comprehensive quality of Hainan golf boys. It is hoped that these suggestions will play a good role in promoting the labor rights and interests of golf children and promoting the harmonious development of the relationship between caddies and golf companies.
