基于“系统—实证”论的中药产业法律保障体系研究

【摘要】：国家《中医药法》实施在即,将对中医药相关法律制度的建设起到极大的引领作用。一部法律的实施过程中,需要有一系列与之配套的具体规范形成制度体系,才能够实现法律所进行的基本制度设计和相对宏观的法律规定。《中医药法》实施的初期会产生一个较为急迫的制度建设需求期,也是推动中医药法制建设的高潮期,《中医药法》中将“中药保护与发展”作为了专章进行立法,对中药产业相关法律制度建设提出了法律层面的需求和指引。本文契合中医药法制建设的需求,围绕中药产业发展相关法律制度展开研究。对中药产业相关法律制度的建设与完善,应该着眼于中药产业的整体,进行系统的制度建设,构建一个中药产业发展的法律保障体系。基于构建法律体系的目标,本文主要的研究任务是创设中药产业法律保障体系的构建方法、探索构建法律体系的基本原则,进而将构建方法和指导原则初步应用,建设中药产业发展法律保障体系主要制度模块。在论文篇章结构布局上,本文主要分为以下五个部分:1.中药产业法律保障体系建设趋向研究。通过梳理中药产业发展相关立法现状,从两个方面对法律保障体系的趋向进行研究:一是从法制建设自身发展规律的视角判断,中药产业发展相关法律建设具备系统化建设的发展趋向和客观基础;二是从中药材、中药饮片、中成药和院内制剂四个主要领域查找中药产业发展相关法律制度缺失的明显点,也是制度建设中的关注点。我国中药产业法律保障体系建设趋向表明构建中药产业法律保障体系具备法制建设和产业发展的双重基础。2.中药产业法律保障体系构建方法研究。目前我国立法还没有建立起中药产业发展法律保障体系,要完成建设法律保障体系的任务,从根本上讲要首先进行方法论的研究,创设构建中药产业发展法律保障体系的方法。通过对系统法学的总结和借鉴,并吸收了实证主义法学的基本观点,本文针对中药产业发展和法制建设的基础,提出“系统—实证”论。“系统—实证”论吸收法学系统论与法学实证论的思想和观点,对中药产业发展法律保障体系提出更具针对性制度构建方法。“系统—实证”论的方法是本文研究的重点之一,也是文章主要的创新点之一。3.中药产业法律保障体系构建基本原则研究。基本原则是指导法律制度建设的指导思想,也是法律规则制定过程中的基本准则。研究和确立中药产业发展保障体系构建的基本原则,可以对我国现在建设法律保障体系、以及在未来不断完善此法律体系都具有明显的指导作用。本文研究中从法制建设自身发展规律的视角、中药产业发展实际需求的视角和体系化建设方法的视角等不同角度探索了中药产业发展法律保障体系构建的基本原则。从不同视角开展的法律保障体系构建基本原则的研究也是本文的创新点之一。4对中药产业法律保障体系各制度模块研究。在“系统—实证”论的指导下,本文对中药产业发展法律保障体系的构建采取了模块归类、逐层拓展的建设方法。依据与中药产业发展这一主题的关系,对相关法律制度进行分类划分,确定了核心性制度模块、支撑性制度模块、关联性制度模块三个中药产业发展法律保障体系组成部分。通过制度模块的建设方法形成有序排列法律制度群,然后在这个制度群中不断深化对具体制度的建设,依靠这种方法不断推进可以逐步建设起一个相对成熟中药产业发展法律保障体系。对中药产业发展法律保障体系建设的具体步骤上采取的模块归类、逐层拓展,逐步构建成制度体系的方法也是本文的创新点之一。5.研究的总结与展望。这部分是对全文的总结,主要是在对中药产业发展法律保障体系这一“系统化”思维的回顾,也对文章研究中的不足进行了反思,并且对后续研究的方向提出了初步的设想。中药产业是我国医药卫生事业的重要组成部分,当前对中药产业发展相关法律问题的研究还处于初级阶段。要确实保障和促进中药产业的发展,就需要一个相对完整法律体系来提供保障。所以,对中药产业发展法律保障体系的整体性研究和构建可以系统的分析和解决我国中药产业发展中面临的实际问题;可以对立法和行业管理形成具有指导意义和参考价值的新思路;也可以起到丰富中医药理论体系和为国家《中医药法》的实施进行先期制度建设的作用。通过本文的研究,创设了构建中药产业法律保障体系的方法、确立了构建中药产业法律保障体系的基本原则、探索了中药产业法律保障体系的基本组成模块,初步实现了构建中药产业发展法律保障体系的目标。
