论土地利用规划权力的经济法属性

【摘要】：厘清土地利用规划权力的法律属性涉及到将政府行使规划权力的行为纳入到法治化轨道中,也涉及土地利用规划法治化路径的选择问题。土地利用规划权力在宏观层面属于宏观调控权,在微观层面属于市场规制权。土地利用规划行为与经济法的制度功能具有契合性。确定土地利用规划权力的经济法属性有助于维护土地市场的正常秩序、协调土地资源的利益分配关系以及促进土地资源的可持续利用。因此,我国应当从经济法视域下进行土地利用规划权力制度模式设计。
[Abstract]:To clarify the legal attributes of the power of land use planning involves bringing the behavior of the government into the track of rule of law and the choice of the path of the rule of law of the land use planning. The power of land use planning belongs to the macro-control power at the macro level and the market regulation power at the micro level. The behavior of land use planning and the system function of economic law are in accord with each other. Determining the economic law attribute of the land use planning power is helpful to maintain the normal order of the land market, to coordinate the benefit distribution relationship of the land resources and to promote the sustainable utilization of the land resources. Therefore, China should design land use planning power system from the perspective of economic law.
