中国社会组织健康发展的法制保障探究

【摘要】：社会组织在当今社会已经担任着越来越重要的角色,尤其是在社会管理方面,它将作为一种新生力量在社会管理等各个方面发挥其独有的作用,这也是由社会的发展阶段所决定的。但社会组织发展的同时难免遇到一些问题,比如法律制度不健全、登记管理体制不科学、内部管理制度疏漏、监管不到位等问题。本文一共分为绪论、正文和结语,绪论部分阐述了本课题的研究背景和研究意义、国内外研究综述、研究内容和研究方法;正文的第一部分从社会组织的发展入手,阐述了社会组织发展的历程、社会组织发展取得的成就。本文的第二部分介绍了当前社会组织发展遇到的困境,并针对当前社会组织发展遇到的困境进行了法制原因分析和非法制原因分析,具体的从社会组织的法制建设滞后;社会组织设立的登记管理体制不科学;对社会组织的监管机制缺失、不健全;对社会组织的内部治理机构规定存在疏漏;对社会组织的激励保障机制空泛等几个法制方面进行了详细阐述,并从非法制层面上进行了简要介绍,分析了阻碍社会组织发展的原因。本文的第三部分阐述了国外一些发达国家社会组织发展的法制保障以及对我国的启示,分别介绍了美国、德国、日本、新加坡等国,针对以上各国的可取之处,提出了对我国的经验启示。本文的第四部分介绍了针对当前我国社会组织存在的问题,该如何采取措施去应对。分别从健全社会组织的相关政策和法律、完善社会组织登记管理体制、创新社会组织社会监管机制、健全社会组织内部治理机构、激励保障机制和其他方面加以详细介绍。结语则对全文进行了归纳和总结,提炼了本文研究过程中得到的一些重要观点,以及今后的努力方向。总之,一切都是为了给社会组织的发展创造一个更好的法制环境,从更高层面来讲,也是为促进社会组织的持续健康发展,为社会组织的良性发展提供法制保障。
[Abstract]:Social organizations have played a more and more important role in today's society, especially in the field of social management. As a new force, social organizations will play their unique role in various aspects of social management, such as social management. This is also determined by the stage of development of society. However, the development of social organizations will inevitably encounter some problems, such as imperfect legal system, unscientific registration management system, omission of internal management system, inadequate supervision and so on. This paper is divided into introduction, text and conclusion, the introduction part describes the research background and significance of this topic, the domestic and foreign research review, research content and research methods; the first part of the text from the development of social organizations, This paper expounds the course of the development of social organization and the achievement of the development of social organization. The second part of this paper introduces the difficulties encountered in the development of social organizations, and analyzes the legal reasons and illegal causes of the difficulties encountered in the development of social organizations, specifically from the legal construction of social organizations lagging behind; The registration management system set up by social organizations is unscientific, the supervision mechanism of social organizations is lacking and imperfect, and there are omissions in the regulation of the internal governance institutions of social organizations. This paper expounds in detail several aspects of the legal system, such as the empty mechanism of incentive and guarantee of social organizations, and briefly introduces them from the level of illegal system, and analyzes the reasons that hinder the development of social organizations. The third part of this paper expounds the legal guarantee of the development of social organization in some developed countries and its enlightenment to our country, and introduces the United States, Germany, Japan, Singapore and other countries respectively, aiming at the merits of the above countries. The experience and enlightenment to our country are put forward. The fourth part of this paper introduces the existing problems in China's social organizations, and how to take measures to deal with them. This paper introduces in detail the relevant policies and laws of social organizations, perfecting the registration and management system of social organizations, innovating the social supervision mechanism of social organizations, perfecting the internal governance institutions of social organizations, encouraging and guaranteeing mechanisms and other aspects. The conclusion summarizes and summarizes the full text, abstracts some important points of view obtained in the course of this research and the direction of future efforts. In short, all is to create a better legal environment for the development of social organizations, from a higher level, but also to promote the sustainable and healthy development of social organizations, to provide legal protection for the healthy development of social organizations.
