欧美社会福利立法典范的制度演变与历史规律

【摘要】：2010年是中国社会福利元年,标志中国社会福利、社会福利立法与社会福利财政时代来临。如何建构中国特色现代社会福利制度框架成为国家发展社会政策与战略目标。本文按照历史发展顺序,首次简要描述了英国17-19世纪社会救助立法与济贫制度,英国18-19世纪劳动就业工厂立法与公共健康立法,德国19世纪社会政策、社会立法与社会保险制度,20世纪早期英国社会保险与社会服务体系,20世纪30年代美国社会保障立法与社会保障制度,20世纪中期社会福利立法与福利国家制度,20世纪晚期福利国家改革与福利治理典范,21世纪早期全球社会政策与全球软法福利治理模式,共计八种社会福利立法典范的历史演变轨迹和结构性特征。概括了西方社会福利立法典范变迁的时代特征和发展规律;分析了社会福利法律体系结构性转型的普遍规律;揭示了欧美社会由社会控制、社会行政、社会政策、社会福利到社会治理制度的演进逻辑,发现西方社会福利法律制度由社会救助,经过社会保险与社会保障阶段,发展到社会福利和社会福祉,由民族主权国家福利立法发展为全球社会政策与社会福利立法等发展规律;指出了西方国家政治、法律与福利制度现代化历程与结构转型方向,为法治国家与福利中国建设提供历史借鉴,为中国特色社会福利法律制度建设奠定制度基础。
[Abstract]:2010 is the first year of China's social welfare, marking the coming of China's social welfare, social welfare legislation and social welfare financial era. How to construct the framework of modern social welfare system with Chinese characteristics has become the national development social policy and strategic goal. According to the order of historical development, this paper briefly describes for the first time the legislation on social assistance and the system of poverty relief in Britain in the 17th and 19th centuries, the legislation on employment factories and public health legislation in Britain in the 18th and 19th centuries, and the social policy of Germany in the 19th century. Social legislation and Social Security system in early 20th Century in Britain Social Security legislation and Social Security system in the United States of America in the 1930s and Social Welfare legislation and Welfare State system in the mid-20th century Model of Welfare State Reform and Welfare Governance in the late 1900s; Global Social Policy and Global soft Law Welfare Governance Model in the early 21st Century, A total of eight models of social welfare legislation of the historical evolution of the track and structural characteristics. This paper summarizes the characteristics of the times and the law of development of the model changes of the western social welfare legislation, analyzes the general law of the structural transformation of the legal system of social welfare, reveals the social control, social administration and social policies in Europe and the United States. The evolution logic from social welfare to social governance system shows that the western social welfare legal system has developed from social assistance to social welfare and social welfare through the stage of social insurance and social security. From the national sovereign state welfare legislation to the global social policy and social welfare legislation, the paper points out the modernization course and structural transformation direction of western countries' politics, law and welfare system. It provides a historical reference for the construction of a country ruled by law and welfare China, and lays a foundation for the construction of the legal system of social welfare with Chinese characteristics.
