【摘要】：目前,农村建设用地面积数量大,利用效率低。随着农村人口的大量进入城市,宅基地闲置严重,阻碍城乡经济社会发展进程一体化,寻求宅基地退出公正补偿显得非常迫切。退出闲置的农村宅基地,这与土地保护和资源利用有关,而且也是经济社会发展的客观需求,同时也是对农民财产权的保护,农村宅基地退出补偿制度发展也就势所必然。能否合理补偿适当安置退宅农民,直接影响城市化发展进程,建立健全现行农村宅基地退出补偿制度是当务之急。本文试图研究我国农村宅基地退出补偿问题,以期探求适合我国国情的农村宅基地退出补偿法律制度,保障农民正当权益,实现土地资源优化配置。全文按照总分结构总共分为五章:第一章是分析农村宅基地退出补偿理论基础,把握农村宅基地退出补偿概念和理论基础。第二章是剖析农村宅基地退出补偿的必要性和可行性。首先强调农村宅基地退出补偿有利于促进城镇化和农业现代化等意义。其次从法律法规、政策背景两个方面论证退出补偿的可行性。第三章是关于农村宅基地退出补偿现状和困境。首先是对退出补偿现状介绍,其次分析所面临的困境,从法律政策及相关问题分析,强调现阶段操作已经无法适应现实需要,应完善农村宅基地退出补偿制度的有力论证。第四章是农村宅基地退出补偿的试点及其启示,对其进行比较归纳,分析优劣之处,以实现扬长避短,吸收借鉴。第五章是完善农村宅基地退出补偿制度具体制度及配套制度,分别从补偿的基本原则、主体、方式、标准及内容等方面进行完善,辅之以建立城乡一体化户籍制度、完善农民权益保障机制、实施政府权力清单制度以及构建农村宅基地退出补偿救济制度相关配套政策及措施,从而建立起“符国情、合民心、促发展”的农村宅基地退出补偿制度。
[Abstract]:At present, the area of rural construction land is large, the utilization efficiency is low. With the large number of rural people entering the city, the homestead is idle seriously, which hinders the integration of urban and rural economic and social development, so it is very urgent to seek fair compensation for the homestead withdrawal. Withdrawing from the idle rural homestead is related to the protection of land and the utilization of resources, and is also the objective demand of economic and social development, and also the protection of farmers' property rights, so the development of rural homestead withdrawal compensation system is inevitable. It is urgent to establish and perfect the current rural homestead withdrawal compensation system. This paper attempts to study the issue of rural homestead withdrawal compensation in China, in order to explore the legal system of rural homestead withdrawal compensation, to protect the legitimate rights and interests of farmers, and to achieve the optimal allocation of land resources. The paper is divided into five chapters according to the total structure: the first chapter is to analyze the theoretical basis of rural homestead withdrawal compensation, grasp the concept and theoretical basis of rural homestead withdrawal compensation. The second chapter is to analyze the necessity and feasibility of rural homestead withdrawal compensation. First of all, it emphasizes the significance of rural homestead withdrawal compensation to promote urbanization and agricultural modernization. Secondly, the feasibility of withdrawing compensation is demonstrated from two aspects: laws and regulations and policy background. The third chapter is about the current situation and predicament of rural homestead withdrawal compensation. First of all, it introduces the current situation of withdrawal compensation, secondly analyzes the difficulties faced, from the analysis of legal policies and related problems, emphasizes that the current operation has been unable to meet the actual needs, and should improve the rural homestead withdrawal compensation system. The fourth chapter is the rural homestead withdrawal from the pilot and its inspiration, comparative analysis of its advantages and disadvantages, in order to achieve strengths and circumvent weaknesses, absorb reference. The fifth chapter is to perfect the specific system of rural homestead withdrawal compensation system and supporting system, respectively from the basic principles of compensation, the main body, the way, standards and content to improve, supplemented by the establishment of urban and rural integration of household registration system. Perfecting the protection mechanism of farmers' rights and interests, implementing the government power list system and constructing the relevant policies and measures related to the rural homestead withdrawal compensation and relief system, so as to establish "accord with the national conditions and accord with the people's hearts," Promote the development of rural homestead out of the compensation system.
