试论食品安全可追溯制度

【摘要】:随着经济的发展和人民生活水平的提高,人们对食品安全和质量的要求越来越高。而近些年,,在人们赖以生存的食品行业,三聚氰胺奶粉事件、苏丹红事件、含镉毒大米等食品安全事件频频爆发,挑战着消费者对食品安全的信任和信心,也使得食品安全监管问题备受关注。 为重塑消费者对食品安全的信心,我国2009年出台《食品安全法》试图建立从农田到餐桌的全程监管,但是收效甚微。近几年随着食品安全监管经验的积累,监管机构认识到,要从源头控制食品安全问题,建立食品安全事前防控机制,引进国外食品安全可追溯体系。目前,我国食品安全可追溯制度的构建已经取得一定成效,但在立法方面仍然存在着一系列问题。 本文通过对比介绍中美食品安全可追溯制度,分析美国食品安全可追溯制度监管格局和立法体系对于中国的启示,为建立完善的食品安全可追溯制度提出立法建议。 第一部分,绪论。对本文的研究对象所处背景和意义做详细介绍,提出本文研究的目标、研究的思路和研究的内容,以及对本文所涉及的相关概念进行了明确。第二部分,食品安全可追溯制度概述。对食品安全可追溯制度的理论根源、基本原理、类型和基本功能进行系统介绍。第三部分,美国食品安全可追溯制度。从监管格局和立法两方面来介绍美国食品安全可追溯制度,并得出对中国的启示和可借鉴之处。第四部分,中国食品安全可追溯制度。第一节介绍2013年大部制改革,并分析改革对建立食品安全可追溯制度所作出的铺垫工作;第二节介绍中国目前形成的食品安全可追溯制度立法现状,并分析其不足与缺陷。第五部分,通过对比分析中美两国的食品安全可追溯制度建设情况,在借鉴美国经验的基础上,提出完善食品安全可追溯制度的立法建议。第六部分,得出结论。
[Abstract]:With the development of the economy and the improvement of the people's living standards, the demand for food safety and quality is becoming more and more high. In recent years, in the food industry that people rely on, the incidents of melamine milk powder, Sudan red, and cadmium containing rice frequently erupt, challenging consumers' trust and confidence in food safety. The issue of food safety regulation has attracted much attention.
In order to reshape the consumer's confidence in food safety, China introduced the food safety law in 2009, trying to establish the whole course supervision from the farmland to the table, but with little effect. In recent years, with the accumulation of food safety supervision experience, the regulators realized that the problem of food safety should be controlled from the source, and the pre control mechanism of food safety should be established and the importing country should be established. At present, some achievements have been made in the construction of the traceability system for food safety in China, but there are still a series of problems in the legislation.
Through the comparison and introduction of the traceability system of food safety in China and the United States, this paper analyzes the revelation of the regulatory framework and legislative system of the traceability system of food safety in the United States, and puts forward legislative proposals for the establishment of a perfect traceability system for food safety.
The first part is introduction. It introduces the background and significance of the research object in detail, puts forward the objectives of the study, the ideas and contents of the research, and makes clear the related concepts involved in this article. The second part, the overview of the traceability system of food safety. The theoretical roots of the traceability system for food safety are basic. The third part, the United States food safety traceability system, introduced the traceability system of American food safety from two aspects of supervision pattern and legislation, and drew the inspiration and reference of China. The fourth part, the traceability system of food safety in China. The first section introduces the 2013 major system reform. The second section introduces the present status of the legislation of the food safety traceability system in China, and analyzes its shortcomings and shortcomings. The fifth part, through a comparative analysis of the construction of the traceability system of food safety in both China and the United States, is a reference to the basis of American experience. On the basis of this, we put forward the legislative proposals to improve the traceability system of food safety. The sixth part draws the conclusion.
