【摘要】：2003年“非典”事件引发行政问责以来,我国开始了重大行政决策法律责任追究制度的建设步伐。党的十八届四中全会审议通过的《中共中央关于全面推进依法治国若干重大问题的决定》提出“要建立重大决策终身责任追究制度及责任倒查机制,对决策严重失误或者依法应该及时作出决策但久拖不决造成重大损失、恶劣影响的,严格追究行政首长、负有责任的其他领导人员和相关责任人员的法律责任。”这标志我国重大行政决策法律责任制度建立健全迈出重要一步。本文以更好地发挥重大行政决策法律责任制度在推动法治政府和责任政府建设,实现国家治理体系和治理能力现代化建设的作用为重点,从重大行政决策法律责任制度的基本概念、理论基础和现实意义出发,分析借鉴先进国家和地区的重大行政决策法律责任制度建设经验,客观分析了当前我国重大行政决策法律责任制度建设的缺陷和不足,并从完善顶层设计、细化重大行政决策程序、明确责任追究主体、细化责任追究范围、厘清责任追究对象、明确法律责任类型和追责时效问题等七个方面论述了我国重大行政决策法律责任制度建设的具体完善举措。
[Abstract]:Since the SARS incident triggered administrative accountability in 2003, China has begun the construction of the system of legal accountability for major administrative decisions. The "decision of the CPC Central Committee on comprehensively promoting the Rule of Law on several important issues" adopted by the fourth Plenary session of the 18th CPC Central Committee proposed that "We should establish a system of lifelong responsibility for major decision-making and an investigation mechanism for responsibility inversion." If a decision is made seriously wrong or should be made in a timely manner according to law, but if the decision is delayed for a long time and has caused great losses, if it is adversely affected, the legal responsibility of the executive head, other leading personnel and relevant responsible personnel who are responsible shall be strictly investigated. " This marks an important step forward in establishing and perfecting the legal liability system for major administrative decisions in China. This paper focuses on the role of the legal responsibility system of major administrative decision-making in promoting the construction of the government ruled by law and the responsible government, and realizing the modernization of the national governance system and governance capacity. Based on the basic concept, theoretical basis and practical significance of the legal responsibility system for major administrative decision making, this paper analyzes and draws lessons from the experience of the construction of the legal responsibility system of major administrative decision making in advanced countries and regions. This paper objectively analyzes the defects and shortcomings of the construction of the legal responsibility system of the major administrative decision making in our country, and clarifies the main body, the scope and the object of the responsibility investigation from the perfection of the top-level design, the refinement of the major administrative decision-making procedure, the clarification of the main body of the responsibility investigation, the refinement of the scope of the This paper discusses the concrete measures to improve the construction of the legal responsibility system of major administrative decision-making in China from seven aspects, such as clarifying the types of legal liability and the problem of limitation of liability.
