【摘要】：本文从对它的监管中面临问题谈起,将在监管行为中表现出的症结分别从立法方面、行政监管方面和司法实务方面进行重点分析,得出我国食品标签在立法方面的滞后、行政监管领域的固有弊病、司法领域诸多裁判标准的不明晰等问题。立法方面具体细化为食品标签立法框架制度规划不周、食品标签程序制度立法不足、食品标签保护制度有待完善、消费者的食品标签权益维护制度缺漏;行政监管方面细化为食品标签行政监管过度与不足并存、食品标签公众监管参与缺乏、食品标签监管信息披露不足;司法实务方面细化为食品标签司法程序介入不足、食品标签法律责任适用混乱。在充分的分析我国食品标签法律监管目前面临的问题之后,带着问题思路在国内的实践经验和国外的完善的实践经验的参考之下,本文提出对我国食品标签法律监管制度予以完善的建议。基于上述提出的法律思维视角,完善建议也分别从立法、行政监管、司法方面进行论述。立法方面分为及时完善食品标签的立法框架制度、完善食品标签立法修改废程序制度、加快完善食品标签保护制度、完善公众对食品标签诉求保障制度;行政监管方面分为坚持食品标签行政监管的适度、强化食品标签监管的社会参与度、明确食品标签监管的信息披露制度;司法实务方面分为放宽食品标签司法介入的范围、合理适用食品标签惩罚性制度。
[Abstract]:This article starts with the problems it faces in the supervision, analyzes the crux of the supervision behavior from the legislative aspect, the administrative supervision aspect and the judicial practice aspect, and draws the conclusion that the food label in our country lags behind in the legislative aspect. The inherent defects in the field of administrative supervision, judicial field of many judicial standards are not clear and so on. In the aspect of legislation, it is specified that the food labelling legislative framework is not well planned, the food labelling procedure system is not enough, the food labelling protection system needs to be perfected, and the food labelling rights and interests maintenance system of consumers is missing. The administrative supervision is divided into the coexistence of excessive and insufficient administrative supervision of food labelling, the lack of public participation in the supervision of food labelling, the insufficient disclosure of information on food labelling supervision, and the insufficient involvement of judicial procedures in food labelling in judicial practice. The legal liability for food labelling applies to confusion. After a full analysis of the problems faced by the legal supervision of food labelling in our country, with the thinking of the problem, we can refer to the domestic practice experience and the foreign perfect practical experience. This paper puts forward some suggestions on how to perfect the legal supervision system of food labelling in China. Based on the above-mentioned perspective of legal thinking, the perfect suggestions are discussed separately from the aspects of legislation, administrative supervision and judicature. In the aspect of legislation, it includes perfecting the legislative framework system of food labelling in time, perfecting the waste procedure system of food labelling legislation, speeding up the improvement of food labelling protection system, and perfecting the public security system for the appeal of food labelling; In the aspect of administrative supervision, it is divided into two parts: to insist on the appropriate administrative supervision of food labelling, to strengthen the social participation in the supervision of food labelling, and to clarify the information disclosure system of food labelling supervision; the judicial practice is divided into the scope of relaxing the judicial intervention of food labelling, The punitive system of food labelling should be applied reasonably.
