征地拆迁的司法介入实例考察

【摘要】:近年来,随着我国社会经济政治文化的快速发展以及城市化的进程日益加快,房屋的征地和补偿成为实现城乡一体化、旧城换新城、建设新农村的重中之重,伴随着的房屋征地补偿矛盾的不断出现,如何解决应对征地拆迁所带来的社会问题以及法律问题成为一个亟待解决的难题。然而,法律作为制度上的根本保障,在调节社会矛盾、解决利益冲突的问题上起到了根本的作用,本文以研究行政拆迁诉讼实例为切入点,进而剖析因房屋征地补偿带来的问题背后的深层次问题。本文主要针对历年来发表刊登的学位论文、学术期刊以及最高院发布的关于房屋征收与拆迁的指导性案例进行研究,对《城市房屋拆迁管理条例》以及《国有土地上房屋征收与补偿条例》在公布实施后对房屋征收与补偿的实际影响进行探究,归纳出在法律上,房屋征收补偿制度体现的问题以及弊端,本人认为,弊端大致集中在以下四点:第一,房屋拆迁补偿原则和标准模糊不确定。第二,房屋拆迁补偿标准不能依据市场规律变化,具有一定的滞后性。第三,从程序上,行政拆迁裁决拆的公开性和公正性无法保证。最后,“司法强拆”制度仍有待完善。最后,针对本文所提出的问题,本人在全面分析历史、案例、法规以及其他作者的观点后,结合社会实际提出四点意见:加强对我国房屋征收与补偿的立法、更加注重对私人权利的维护;将行政征收补偿的标准市场化、使被拆迁人拥有更多补偿方式的选择权;转变行政机关的执法理念,致力于建设服务性政府;完善房屋征地拆迁的程序。这样能够从根本上保护被拆迁人的权利,创建规范和谐的制度环境。
[Abstract]:In recent years, with the rapid development of social economy, politics and culture in our country and the accelerating process of urbanization, land requisition and compensation of houses have become the most important task in realizing the integration of urban and rural areas, changing old cities for new towns, and building new rural areas. With the continuous emergence of the contradiction of compensation for land requisition, how to solve the social and legal problems caused by land requisition and demolition has become a difficult problem to be solved. However, as the fundamental guarantee of the system, law plays a fundamental role in regulating social contradictions and resolving conflicts of interest. Then analyze the deep problems behind the problems caused by the compensation for land requisition. This paper focuses on the studies of academic papers published over the years, academic journals and instructive cases of house expropriation and demolition published by the Supreme Court. This paper probes into the actual effects of the regulations on the Administration of Urban Housing demolition and relocation and the regulations on the Collection and compensation of Housing on State-owned Land after the promulgation and implementation of the regulations, and sums up the legal implications of the regulations on the collection and compensation of houses. In my opinion, the shortcomings of the system of house expropriation and compensation are mainly focused on the following four points: first, the principle and standard of compensation for house demolition are vague and uncertain. Second, housing demolition compensation standards can not be changed according to the market law, with a lag. Thirdly, from the procedure, the openness and fairness of the administrative demolition ruling cannot be guaranteed. Finally, the system of judicial demolition still needs to be improved. Finally, in view of the questions raised in this paper, after analyzing the history, cases, laws and regulations and other authors' views, I put forward four suggestions: strengthening the legislation on the collection and compensation of housing in our country. Pay more attention to the protection of private rights; make the standard of administrative levy and compensation market-oriented, so that the relocation people have more options of compensation, change the law enforcement concept of the administrative organs, and devote themselves to the construction of a service-oriented government; Perfect the procedure of house land requisition and removal. This can fundamentally protect the rights of the removed person and create a standardized and harmonious institutional environment.
