非正常信访现象的法律思考

【摘要】：近年来非正常信访形势越来越严峻,呈现为规模大、参与人数多、频发、主体多元化等特点。该现象为社会发展带了很多消极影响,严重干扰了“依法治国”方略的推进,阻碍了“依法行政”,成为影响社会稳定的突出问题。如何采取行之有效的措施将该现象消除掉,是目前信访理论实务界最为关注的问题。本文从概念、表现形式及带来的消极后果三个方面对非正常信访现象的现状进行了分析。并对该现象产生的原因进行了挖掘,找到了非正常信访现象频发的两个主要原因是信访制度存在问题和其他救济渠道不畅通。在此基础上从信访机制的定位、信访受理范围的调整、信访机构的设置、信访程序的规定、信访考核机制的完善和责任追究机制的落实以及其他法定诉求渠道的畅通几个方面探讨和寻求解决问题、突破困境的法制路径。制定科学的制度,颁布相应的法律,健全问题解决的机构,完善化解矛盾的工作机制,拓展矛盾解决的法制渠道,促进非正常信访现象的有效化解,维护正常的信访秩序,推动信访工作的良性发展,确保社会的和谐稳定。
[Abstract]:In recent years, the situation of abnormal letters and visits is becoming more and more serious, which is characterized by large scale, large number of participants, frequent occurrence and diversification of subjects. This phenomenon has brought a lot of negative influence to the social development, seriously interfered with the advance of the general plan of "governing the country by law", hindered the "administration by law", and became a prominent problem affecting the social stability. How to take effective measures to eliminate this phenomenon is the most concerned problem in the field of petition theory and practice. This paper analyzes the present situation of abnormal petition phenomenon from three aspects: concept, manifestation and negative consequences. The causes of this phenomenon have been excavated and two main reasons for the frequent occurrence of abnormal letters and visits have been found. The problems in the letter and visit system and other relief channels are not smooth. On this basis, the orientation of the petition mechanism, the adjustment of the scope of receiving and accepting the petition, the setting up of the petition organization, the provisions of the petition procedure, The perfection of the appraising mechanism of letters and visits, the implementation of the accountability mechanism and the unblocked channels of other legal demands are discussed and sought to solve the problems in order to break through the legal path of the dilemma. To formulate a scientific system, promulgate corresponding laws, perfect the organization for solving problems, perfect the working mechanism for resolving contradictions, expand the legal channels for resolving contradictions, promote the effective resolution of abnormal phenomena of letters and visits, and maintain the normal order of letters and visits. To promote the sound development of petition work to ensure social harmony and stability.
