论我国职业教育法律体系的完善

【摘要】：职业教育关乎中国制造,关乎中国在未来由谁制造。作为一项基础性工程,以提高劳动者素质,增强民族产业的竞争力,职业教育在国民经济和社会发展中具有不可替代的作用。职业教育的制度化、可持续的发展,有赖于职业教育法律紧随时代步伐,及时设立、修改、废止相关领域的法律,依据我国国情,推动职业教育、健康可持续发展,构建相应的职业教育法律体系已是不二之选。中国目前的《职业教育法》在1996颁布和实施,已经18年了,到目前为止《职业教育法》的修订已列入修订计划,但尚未颁布。职业教育随着经济的发展问题凸显,而相关的配套法律法规体系不健全,在职业教育发展的过程中无法提供有力的保障,职业教育相关领域法律制度的建设迫在眉睫。本文在分析我国职业教育的现状及职业教育法律体系的因素之基础上,通过对德国、美国、英国、日本等四个国家的职业教育立法的相关经验分析、借鉴,对我国职业法律体系的建立提出建议,以期达到通过法律体系之完善促进职业教育健康、可持续发展。
[Abstract]:Vocational education is about making in China and who will make it in the future. As a basic project, vocational education plays an irreplaceable role in the development of national economy and society in order to improve the quality of laborers and enhance the competitiveness of national industries. The institutionalization and sustainable development of vocational education depend on the law of vocational education following the pace of the times, establishing, modifying and repealing the laws in related fields in time, promoting vocational education and healthy and sustainable development according to the national conditions of our country. It is necessary to construct the corresponding legal system of vocational education. China's current Vocational Education Law has been promulgated and implemented in 1996 for 18 years. So far, the revision of the Vocational Education Law has been included in the revision plan, but it has not yet been promulgated. With the development of economy, the problem of vocational education is prominent, and the relevant supporting laws and regulations system is not perfect, which can not provide a strong guarantee in the process of the development of vocational education, so the construction of the legal system in the related fields of vocational education is urgent. Based on the analysis of the current situation of vocational education and the factors of the legal system of vocational education in China, this paper analyzes the relevant experiences of the vocational education legislation in Germany, the United States, the United Kingdom and Japan. This paper puts forward some suggestions on the establishment of professional legal system in order to promote the healthy and sustainable development of vocational education through the perfection of the legal system.
