退休制度的法律问题研究

【摘要】：自建国以来,中国的退休制度走过了半个多世纪的历程,随着社会经济的快速发展,与退休制度相关的法律法规显然跟不上社会经济发展的脚步。因此,需要需要对其进行更新完善,这样才能更好维护劳动者的权益。在完善过程中,将追求平等、公平的退休制度,作为追求的终极目标,并在实施过程中体现对弱势群体的人文关怀。所以,以退休立法为研究对象,对退休制度存在的一系列法律问题进行了相对深入的研究。本文共分为四大部分,基本内容如下：第一部分是退休制度的基本概述,本部分主要论述两方面的内容,一是退休及退休法律制度的基本内涵,二是我国退休制度发展的历史沿革。第二部分是对国外退休法律制度的考察,通过对国外的退休年龄、退休金给付的法律保障、退休权的法律救济的现实困惑三个方面内容的分析,借鉴他国的有益做法,更有益于我国制度的完善。第三部分我国现行退休制度的发展现状,主要从我国退休制度发展中所引发的问题进行分析。第四部分是对我国退休制度完善的建议,主要从合理规范退休年龄,退休金给付双轨制改革,完善退休权法律救济三个方面进行论述。
[Abstract]:Since the founding of the people's Republic of China, China's retirement system has gone through more than half a century. With the rapid development of social economy, the laws and regulations related to the retirement system obviously can not keep up with the pace of social and economic development. Therefore, it needs to be updated and improved, so as to better safeguard the rights and interests of workers. In the process of perfection, we should pursue the equal and fair retirement system as the ultimate goal, and embody the humanistic concern for the vulnerable groups in the process of implementation. Therefore, take retirement legislation as the research object, has carried on the relatively thorough research to the retirement system existence a series of legal problems. This paper is divided into four parts, the basic contents are as follows: the first part is the basic overview of the retirement system, this part mainly discusses two aspects of the content, one is the basic connotation of retirement and retirement legal system, Second, the history of the development of China's retirement system. The second part is the investigation of the foreign retirement legal system, through the analysis of the foreign retirement age, the legal protection of pension payment, the realistic confusion of the legal relief of the retirement right, draw lessons from the beneficial practices of other countries. It is more beneficial to the perfection of our system. The third part analyzes the current situation of China's current retirement system, mainly from the problems caused by the development of China's retirement system. The fourth part is the suggestion to perfect the retirement system of our country, mainly from three aspects: the reasonable standard retirement age, the reform of the double track system of pension benefit, and the perfection of the legal relief of the right of retirement.
