国外公共文化服务保障的立法经验与启示

【摘要】：公共文化服务体现"软实力",对政绩的贡献很难立竿见影,缺乏建设驱动力,唯立法可为其提供权威保障。现阶段我国公共文化服务还主要依靠行业规定、行政手段以及政策文件推动,保障力度有限。2015年,中央与地方开始积极推动公共文化服务保障的立法工作。我国公共文化服务保障立法的实践基础薄弱、经验不足,如何建立完善的公共文化服务法律保障体系成为亟待解决的问题。国外在公共文化服务保障立法方面积累了丰富的经验,值得我国借鉴。文章总结了国外公共文化服务保障立法的五条经验,并结合我国现状,对我国公共文化服务保障的立法工作提出了建议。
[Abstract]:The public cultural service embodies "soft power", and its contribution to political achievements is very difficult to achieve immediately and lacks the driving force of construction, only legislation can provide authority guarantee for it. At present, China's public cultural services mainly rely on industry regulations, administrative means and policy documents to promote, the strength of protection is limited. In 2015, the central and local authorities began to actively promote the legislative work of public cultural service security. The practice foundation of our country public cultural service safeguard legislation is weak, the experience is not enough, how to establish the perfect public culture service legal safeguard system becomes the urgent problem to be solved. Foreign countries have accumulated rich experience in the legislation of public cultural service guarantee, which is worthy of our country's reference. This paper summarizes five experiences of the legislation of public cultural service security in foreign countries, and puts forward some suggestions on the legislative work of the public cultural service guarantee in our country combined with the present situation of our country.
