行政给付裁量权的程序性规制研究

【摘要】:现代给付行政的发展,推动了政府职能的扩张,要求政府提供更多的服务与给付。政府在履行给付职能的过程中,广泛地运用行政裁量权,行政权力涉及的范围不断扩大,深刻影响着社会的发展与民众的生活。为实现政府行政给付保障功能,规范行政给付裁量权运作之目的,有必要建立相应的规制机制。现代社会中,对行政给付的法律规制应当包括实体性规制与程序性规制两个方面。因此,在传统实体性规制的基础上,结合我国当前给付行政的发展实践,需要对行政给付裁量权的程序性规制进行探究。 首先,对行政给付裁量权给予程序性的规制有现实必要性。一是政府行使行政给付裁量权,本质上仍是行政权力的运作过程。其在为民众带来生活保障、服务与利益的同时,如果缺乏相应的规制,行政给付裁量权就容易遭致滥用,并引发一系列的负面效应,危及政府行政权力的运作及行政给付职能的履行,危害个人与社会的健康发展,最终不利于行政给付的良性发展。二是我国关于行政给付及行政给付程序的法治建设较为滞后。通过简单梳理可以发现,有关行政给付规范存在诸多问题,如有关行政给付程序规范的层级较低、对行政给付程序的规定较为缺乏、现有的相关给付程序规定不甚合理等,无法为行政给付裁量权的运作提供足够的规范力量。三是当前的行政给付活动,涉及大量的个人利益与公共利益的协调情况,政府在裁量行政给付中的公共利益时面临诸多困境等。 其次,对行政给付裁量权进行程序性规制,有其本身的优势与可能性。行政给付活动具有较为鲜明的过程性、授益性、非强制性及可参与性等,为公民参行政给付过程提供了极大的可能性,也有助于对行政给付裁量权的行使形成制约与监督力量。我们在构建行政给付裁量权的程序性规制机制时,也应当符合正当性的要求,并能够推进行政给付程序的合理性等。 因此,这使得对行政给付裁量权的规制更显必要,也更复杂,需要我们探究更适宜当下给付实践的可行的规制路径。结合我国行政给付的特点与现状,建构行政给付裁量权的程序性规制机制,或就值得我们思考。首先,应当借助信息公开、听证制度、说明理由等现有制度关于程序的规定,完善政府行政给付中的主要程序制度,并进行有针对性的设计,发挥其程序控权的功能。其次,推进行政给付程序的时间、方式、步骤、顺序等要素的规范化,增强行政给付程序的合理性与规制力。再次,构建从申请到救济的行政给付程序体系,主要包括行政给付的请求程序、参与程序、实现程序及救济程序等。对于给付程序体系的具体设计,可以从以下方面着手:如在给付的请求程序,保证启动方式的多元化;在给付的参与程序,使知情权、监督权、评价权等公民的程序性权利落到实处;在给付的实现程序,贯彻职能分离与便民监督等基本原则;在给付的救济程序,推进救济内容的丰富性、形式的多样性等。希望通过这样的一种思考,能够引起人们更加重视行政给付裁量权的程序性规制,探索出更多更成熟的规制路径与成果,,从而助推我国行政给付制度不断向前发展。
[Abstract]:The development of modern payment administration has promoted the expansion of government functions and required the government to provide more services and payments. In the process of fulfilling the function of payment, the government widely uses administrative discretion, and the scope of administrative power is expanding constantly, deeply affecting the development of the society and the life of the people. In modern society, the legal regulation of administrative payment should include two aspects: substantive regulation and procedural regulation. Therefore, on the basis of traditional substantive regulation, combined with the development practice of current administration in our country, administrative provision needs to be paid. The Procedural Regulation of discretion is explored.
First, it is necessary to give Procedural Regulation to the discretion of administrative payment. One is that the government exercises administrative power of discretion and is still the operation process of administrative power in essence. The negative effect of series endangers the operation of government administrative power and the performance of administrative payment function, endangers the healthy development of individual and society, and ultimately is not conducive to the benign development of administrative payment. Two it is lagging behind the legal construction of administrative provision and administrative payment procedure in our country. There are many problems, such as the lower level of the standard of administrative payment procedures, the lack of regulations on the administrative provision, the unreasonable provisions of the existing relevant payment procedures, and the failure to provide enough normative power for the operation of the administrative discretion. Three is the current administrative provision, involving a large number of personal interests and public interests. In the interest of public interest, the government faces many difficulties when it comes to the public interest in administrative discretion.
Secondly, it has its own advantages and possibilities for the Procedural Regulation of administrative grant discretion. The administrative payment activities have more distinct process, benefit, non mandatory and participatory, which provide a great possibility for citizens to participate in the process of administration and payment, and help to restrict and supervise the exercise of administrative discretion. When we build the Procedural Regulation Mechanism of the administrative discretion, we should also meet the requirements of legitimacy and promote the reasonableness of the administrative payment procedure.
Therefore, it makes it more necessary and more complex to regulate the discretion of administrative payment. It is necessary for us to explore the feasible regulation path which is more suitable for the present practice of payment. The hearing system, explain the reason and so on the provisions of the existing system about the procedure, perfect the main procedural system in the government administration, and carry on the targeted design and play its function of controlling the power of the program. Secondly, promote the standardization of the time, mode, steps, order and other factors of the administrative payment procedure, and strengthen the rationality and regulations of the administrative payment procedure. Thirdly, the system of administrative payment program from application to relief, including the request procedure of administrative payment, participation procedure, implementation procedure and relief program, etc. Procedure, the procedural rights of citizens, such as the right to know, the supervision and the right of evaluation, be put into practice, the implementation procedures of the payment, the implementation of the basic principles of the separation of functions and the supervision of the people, and the enrichment of the relief content and the diversity of forms in the relief program. The Procedural Regulation of administrative discretionary power has explored more and more mature regulation paths and achievements, thus boosting the continuous development of China's administrative benefit system.
