社会保险经办机构功能之立法研究

【摘要】：我国社会保障制度,从"效率优先,兼顾公平"到"以人为本,统筹兼顾",历经了以劳动保险为主体的计划经济时代的社会保障模式到以社会保险为主体的市场经济时代的社会保障模式。在这期间,社会保险立法也从法制化程度较低、内容不够完善等,发展为具有高位阶的统一立法,统一了我国社会保险制度。当前是我国着力建设服务型政府时期,社会保险经办机构作为全国参保的单位和个人进行社会保险公共服务提供的组织,其是否遵循社会保险规章制度的规定和政策的要求、是否合理有效进行社会保险基金的管理等,直接影响我国服务型政府的建设。然而,时至今日《社会保险法》对于社会保险经办机构的性质定位、功能等仍没有明确规定,导致社会保险经办机构工作在实践中出现各地社会保险经办机构具体功能履行不明、社会保险基金征缴与管理混乱等问题。因此,本文认为有必要从立法的高度对社会保险经办机构功能进行重新建构。通过立法对社会保险经办机构功能重新建构,以立法明确经办机构的法律性质和功能,能够更好地明晰其应当承担的具体职责。在此基础上,积极放开对于经办机构所负责的社会管理方面以及公共服务方面所应当具有的权限和享有的权利;同时明确经办机构的法律责任,在经办机构违反法律法规规定或者不履行法定义务时,以法律手段追究其责任。相信经过这样的重新构建,社会保险经办机构的能力能够稳固提升,从而为大众提供更加优质的经办管理服务。因此本文以法学角度从以下几个方面行文:第一章为"社会保险经办机构功能实地调研之分析",主要对调研地社会保险经办机构的功能以及功能履行中的困难进行介绍,由此引出研究社会保险经办机构功能立法的必要性;第二章为"《社会保险法》对社会保险经办机构功能的规定和不足",主要介绍《社会保险法》中对社会保险经办机构功能的规定及存在的不足;第三章为"德国、美国、智利社会保险经办机构功能之立法评析",主要对德国、美国、智利关于社会保险经办机构功能和法律定位作一介绍;第四章"完善社会保险经办机构功能之立法建议",从立法上明确我国社会保险经办机构的功能。
[Abstract]:China's social security system, from "efficiency first, taking into account fairness" to "people-oriented," After taking labor insurance as the main body, the social security model in the planned economy era and the social security model in the market economy era with the social insurance as the main body has gone through. During this period, the legislation of social insurance has also developed from a low degree of legalization and imperfect content to a unified legislation with a high rank, thus unifying the social insurance system of our country. The current period of our country's efforts to build a service-oriented government, social insurance agencies as units and individuals participating in the national social insurance public service provision organizations, whether they comply with the social insurance regulations and policy requirements, Whether it is reasonable and effective to manage the social insurance fund directly affects the construction of the service-oriented government in our country. However, up to now, the Social Insurance Law has not clearly defined the nature and functions of social insurance agencies. In practice, some problems such as unclear functions of social insurance agencies, confusion in collection and management of social insurance funds and so on have occurred in the work of social insurance agencies. Therefore, it is necessary to reconstruct the functions of social insurance agencies from the perspective of legislation. In order to make clear the legal nature and function of the social insurance agency by legislation, it is possible to better clarify the specific responsibilities it should undertake in order to re-construct the function of the social insurance agency by legislation, and to clarify the legal nature and function of the agency through legislation. On this basis, we should actively liberalize the areas of social management and public services that are responsible for the agencies, and clarify the legal responsibilities of the agencies. If the agency violates laws and regulations or fails to fulfill its legal obligations, it shall be held liable by legal means. I believe that through this restructuring, the capacity of social insurance agencies can be steadily enhanced, thus providing better quality management services for the public. The first chapter is an analysis of the functions of social insurance agencies in the field of investigation. It mainly introduces the functions of social insurance agencies and the difficulties in their performance. Therefore, it is necessary to study the function legislation of social insurance agencies. The second chapter is "the social insurance law" to the social insurance agency organization function stipulation and the insufficiency, mainly introduces the "social insurance law" to the social insurance agency organization function stipulation and the existence insufficiency, the third chapter is "Germany, the United States," An Analysis of the legislation on the functions of Social Insurance agencies in Chile, which mainly introduces the functions and legal orientation of social insurance agencies in Germany, the United States and Chile; Chapter four, "legislation suggestion on perfecting the function of social insurance agency", clarifies the function of social insurance agency in our country.
