行政许可法律风险防范机制研究

【摘要】：社会的发展使行政权不断的膨胀,需要行政机关管理的事务越来越多,政府治理发挥越来越重要的作用,不断膨胀的行政权力也会导致政府治理过程中出现多种多样的风险,这些风险都会动摇政府的权威、社会的安定、民众的稳定,因此我们要不断创新风险防范机制来减小政府和社会可能承受的损失,提升社会的安定指数,本文就是在对风险管理理论基础的理解上,通过对我国现阶段行政许可的设定、实施和决策方面的不足的分析,探究出深层次的原因,并针对原因寻找合适的风险规避机制,以促进我国经济的发展,社会的和谐和民众的团结。期待通过对行政许可风险的法律防范机制的建构,降低政府面临风险转化为现实的可能性,减少社会的各种不和谐因素,从而加速法治政府、阳光政府的建设。全文分为五个部分：第一部分“引言”：简单介绍风险在现代社会中作为不可能避免的事务对社会中的民众、各类组织、甚至政府都存在着威胁,而行政许可作为防范社会风险的一种手段,对其风险的防范就显得尤为重要,强调了该选题对现实生活的重要性。第二部分“行政许可风险的理论基础”,从风险、政府治理风险、和行政许可的概念入手,分析行政许可风险的性质,并强调研究行政许可风险的意义。第三部分“我国行政许可风险的现状”,根据现阶段行政法律、法规的清理,行政机关的执法情况和法院的行政许可案件受理情况,分别从行政许可设立中、实施中和监管中的风险来总结我国行政许可行为在现阶段存在的问题。第四部分“行政许可风险的原因分析”,根据我国行政许可的现状分析出可能产生该问题的原因,以明确行政许可风险规避的方向、方式和方法,为建立行政许可法律风险防范机制做铺垫。第五部分“我国行政许可风险法律防范机制的建构”,在总结出建构法律防范机制的必要性基础上,根据前四部分内容的分析和论证,再结合我国的理论和实践,建立系列的制度来达到行政许可法律风险防范的目的。
[Abstract]:With the development of the society, the administrative power is constantly expanding, and more affairs need to be managed by the administrative organs. Government governance plays an increasingly important role. The expanding administrative power will also lead to a variety of risks in the process of government governance. These risks will destabilize the authority of the government, the stability of the society and the stability of the people. Therefore, we must constantly innovate the risk prevention mechanism to reduce the losses that the government and society may suffer, and to enhance the social stability index. This article is in the risk management theory foundation understanding, through the present stage our country administrative license establishment, the implementation and the decision-making aspect insufficiency analysis, explored the deep level reason, and looked for the suitable risk aversion mechanism according to the reason. In order to promote the economic development of our country, social harmony and the unity of the people. Through the construction of the legal prevention mechanism of the risk of administrative license, the author hopes to reduce the possibility that the government is faced with the risk and turn it into reality, and to reduce all kinds of disharmonious factors of the society, so as to accelerate the construction of the government ruled by law and the sunshine government. The full text is divided into five parts: the first part "introduction": a brief introduction to risk in modern society as an inevitable thing to the public, all kinds of organizations, and even the government there is a threat. The third part, "the present situation of the risk of administrative license in our country", according to the cleaning up of administrative laws and regulations, the law enforcement situation of administrative organs and the acceptance of administrative license cases by the court, respectively, from the establishment of administrative license, The risks in implementation and supervision to sum up the problems existing in the present stage of administrative licensing in China. The fourth part "the reason analysis of the administrative license risk", according to the present situation of the administrative license of our country, analyzes the possible cause of this problem, in order to clear the direction, the way and the method of the administrative license risk evading. For the establishment of administrative licensing legal risk prevention mechanism paving the way. The fifth part, "Construction of legal prevention mechanism of administrative license risk", on the basis of summing up the necessity of constructing legal prevention mechanism, combining with the theory and practice of our country, according to the analysis and argumentation of the contents of the first four parts.
