加拿大《国家身体健康法》和《健康与业余体育法》研究及启示

【摘要】：《体育法》修改是当前我国体育法治建设的一项重要任务。文章运用文献研究、比较分析等方法对加拿大的两部体育法——1943年《国家身体健康法》和1961年《健康与业余体育法》进行了研究,探讨了两部法律的立法背景、法律文本内容,并对两部法律进行了评析。研究认为,《国家身体健康法》的实施效果并不如人意,但却开启了加拿大体育立法时代;《健康与业余体育法》则标志着加拿大联邦政府正式从国家层面来推动体育的发展,并成为20世纪后半叶加拿大的主要体育法律,确立了政府促进体育发展的基本制度。就立法经验而言,根据社会发展的需求进行立法和修法、政府合理的介入体育发展、明确体育管理机构的构成和权责、建立体育发展的财政支持制度、对关键性概念进行界定、建立体育法实施评估制度等是对我国体育立法和修法最有借鉴意义的经验。
[Abstract]:The amendment of the Sports Law is an important task in the construction of sports rule of law in China. By means of literature research and comparative analysis, this paper studies two sports laws in Canada, the National physical Health Act of 1943 and the Health and Amateur Sports Act of 1961, and probes into the legislative background of the two laws. The content of the legal text and the evaluation of the two laws. The study concluded that the implementation of the National physical Health Act was not satisfactory, but it opened an era of Canadian sports legislation, while the Health and Amateur Sports Act marked the formal promotion of sports development at the national level by the Canadian Federal Government. It became the main sports law of Canada in the second half of the 20th century, and established the basic system of the government to promote the development of sports. As far as the legislative experience is concerned, according to the needs of social development, the government should legislate and amend the law, the government should intervene in the sports development reasonably, make clear the constitution and responsibility of the sports management organization, establish the financial support system of the sports development, and define the key concepts. Establishing the evaluation system of sports law is the most significant experience for our country's sports legislation and law revision.
