农村污染型环境群体性事件的发生机理及治理路径

【摘要】：当前我国农村地区已经成为污染型环境群体性事件的高发地,深入分析农村污染型环境群体性事件与城市污染型环境群体性事件区别,准确界定农村污染型环境群体性事件的特征,对于治理该类事件意义重大。农村污染型环境群体性事件的发生机理表现为:"环境不公"导致的农民环境权未得到法律确认与保障、现有司法治理不足、环境侵权责任追究乏力。由此提出的治理路径包括:通过立法保障农民环境权、实现环境群体性事件司法治理的制度创新、环境侵权责任的综合运用。
[Abstract]:At present, rural areas in China have become a high incidence of environmental pollution group events. The difference between rural pollution environmental group events and urban pollution environmental group events is analyzed in depth. It is of great significance to define the characteristics of environmental group events in rural areas. The occurrence mechanism of rural environmental pollution group events is that the environmental rights of farmers caused by "environmental injustice" have not been confirmed and protected by law, the existing judicial administration is insufficient, and the environmental tort liability investigation is weak. The proposed governance path includes: protection of farmers' environmental rights through legislation, institutional innovation of judicial governance of environmental mass incidents, and comprehensive application of environmental tort liability.
