交通技术监控违法行为告知问题之完善

【摘要】：交通技术监控违法行为的告知是交通管理部门在行政执法管理过程中的一个必经程序和关键环节，是运用现代化科技手段管理城市道路交通的一种重要的手段，有效的解决了在道路、机动车辆不断上升趋势的情况下，传统的交通警察人力不足、处罚恣意、管理手段有限等问题，一定程度上体现了其执法规范、管理高效的优势。由于目前我国道路交通安全相关法律法规在技术监控违法行为的执法告知方面还不尽完善，深入研究这方面问题，对于道路交通安全执法理论研究和实践均有实际意义。具体来说，文章从以下几个部分进行论述： 第一部分是整理了当前交通技术监控违法行为告知过程中存在的问题。主要是从法律依据、法律原则、执法程序、执法方式等方面，对告知过程中存在的主要问题进行了分析。 第二部分为交通技术监控违法行为的告知制度的涵义及必要性。以行政法学理论为主，结合道路交通安全法律法规及交通管理部门具体工作实践，阐述了其涵义，并分析了完善该行政执法程序的必要性。 第三部分对交通技术监控违法行为告知制度的法律特征进行了分析。分别从告知的前提、方式方法、期间、内容、对象，以及双方的权利义务等方面进行了比较翔实的分析和研究。 第四部分是整理了国内目前交通技术监控违法行为执法告知方面的实践。立法方面，从实体法、程序法及技术规范等3个层面进行了研究。而在具体执法实践中，研究了交通管理部门所做出的一些改进措施等。 第五部分是对进一步完善告知制度的对策和建议。主要从健全相关道路交通安全法律法规、丰富处罚种类、完善告知内容和加强行政管理等4个方面提出了笔者个人的一些建议。
[Abstract]:The notification of illegal activities of traffic technology monitoring is a necessary procedure and key link in the process of administrative law enforcement management of traffic management departments, and it is an important means to use modern scientific and technological means to manage urban road traffic. Effectively solved in the road, motor vehicles rising trend, the traditional traffic police manpower shortage, arbitrary punishment, limited management means and other issues, to a certain extent reflects its law enforcement norms, management efficiency advantages. At present, the related laws and regulations of road traffic safety in our country are not perfect in the aspect of law enforcement and notification of technical monitoring illegal acts, so it is of practical significance for the theoretical research and practice of road traffic safety law enforcement to study this problem in depth. Specifically, the article discusses the following parts: the first part is to sort out the current traffic technology monitoring illegal behavior in the process of informing the existing problems. The main problems in the process of informing are analyzed from the aspects of legal basis, legal principle, law enforcement procedure, law enforcement method and so on. The second part is the meaning and necessity of the information system of traffic technology monitoring illegal behavior. Based on the theory of administrative law, combined with the laws and regulations of road traffic safety and the concrete work practice of traffic management department, this paper expounds its meaning and analyzes the necessity of perfecting the administrative law enforcement procedure. The third part analyzes the legal characteristics of traffic technology monitoring illegal behavior notification system. From the premise, method, period, content, object, and the rights and obligations of both sides of the analysis and research. The fourth part is to sort out the current domestic traffic technology monitoring illegal behavior law enforcement practice. Legislation, from the substantive law, procedural law and technical specifications three levels of research. And in the concrete law enforcement practice, has studied the traffic management department to make some improvement measures and so on. The fifth part is the countermeasure and suggestion to further perfect the system of informing. The author puts forward some personal suggestions from four aspects: perfecting the relevant laws and regulations of road traffic safety, enriching the types of punishment, perfecting the contents of informing and strengthening administration.
