我国进口食品安全监管法律制度研究

【摘要】:随着食品贸易的全球化,,食源性疾病等食品安全问题已经逐步成为了一个世界性问题,引起了各个国家的广泛关注,中国作为世界新兴食品进口大国,亦应积极制定政策保护本国食品市场安全,加强对进口食品的监管,提升进口食品立法水平,参照国际惯例和国际标准,建立切实可行的进口食品监管体系。随着《中华人民共和国食品安全法》的颁行,我国开始建立初具现代化的食品安全风险机制,然而,相较西方发达国家较为完备的安全监管体系而言,我国对进口食品的监管仍处于初级水平,鲜有先进的理念和体制创新,尚未形成一套完整有效的本土机制,监管体系仍不完备,针对进口食品监管的研究尚处于起步阶段。鉴于此,本文第二、三部分将对我国现行法律制度和监管体制进行分析,阐明我国目前立法存在的问题;在第四部分考察了欧美的相关制度架构,以期了解国际食品安全监管立法的现状和发展态势;在文章第五部分基于以上对现存立法空白和立法缺陷,以及国际先进立法制度体系的分析,得出我国进口食品监管立法的完善建议。
[Abstract]:With the globalization of food trade, food safety problems such as foodborne diseases have gradually become a worldwide problem, which has aroused the widespread concern of all countries. China, as a new food importer in the world, We should also actively formulate policies to protect the safety of our food market, strengthen the supervision of imported food, raise the level of legislation on imported food, and establish a feasible regulatory system for imported food according to international practice and international standards. With the enactment of the Food Safety Law of the people's Republic of China, China has begun to establish a modern food safety risk mechanism. However, compared with the more complete safety supervision system in western developed countries, The supervision of imported food in our country is still at the primary level, few advanced ideas and system innovation, has not yet formed a complete and effective local mechanism, the regulatory system is still incomplete, and the research on the supervision of imported food is still in its infancy. In view of this, the second and third parts of this paper will analyze the current legal system and supervision system of our country, clarify the problems existing in the current legislation of our country; in the fourth part, we will examine the relevant institutional framework of Europe and the United States. In the fifth part of the article, based on the above analysis of the existing legislative gaps and shortcomings, as well as the international advanced legislative system, Get the perfect suggestion of our country import food regulation legislation.
