渔业权的确立:日本经验与中国之道

【摘要】：日本渔业权的导入及制度体系的形成与演进历经116年,积累了丰富的经验,对于中国渔业权的确立有许多可以借鉴。文章基于中日两国渔业权概念的辨析和异同比较重新界定了渔业权,继而梳理了日本渔业权的导入和演进过程、法上规定体系以及特性和论点。同时,观察了中国渔业权研究概略和渔业权相关立法进展。笔者认为,《物权法》中作为用益物权的"养殖、捕捞的权利",与"养殖权""捕捞权"之间不存在逻辑上的全同关系;《渔业法》中的"养殖证""捕捞许可证"并不等同于"养殖权""捕捞权"的承认,更不等同于"渔业权""渔业权制度"的创设。故而,必须将"渔业权"明确写入《物权法》和《渔业法》中、弄清渔业权的特性、构筑《渔业法》上渔业权制度体系,才能确立渔业权。
[Abstract]:The introduction of fishery rights and the formation and evolution of the system of fishery rights in Japan have accumulated rich experience after 116 years, which can be used for reference for the establishment of fishery rights in China. Based on the analysis and comparison of the concepts of fishery rights between China and Japan, this paper redefines fishery rights, and then combs the process of introduction and evolution of fishery rights in Japan, the legal system, the characteristics and arguments. At the same time, the research outline of fishery rights and the legislative progress of fishery rights in China are observed. In my opinion, "breeding" in the property Law as usufruct right, There is no logical relationship between "fishing rights" and "aquaculture rights" and "fishing rights". The "aquaculture license" and "fishing permit" in the Fisheries Act are not equivalent to the recognition of "aquaculture rights" and "fishing rights". It is not equal to the creation of fishery right and fishery right system. Therefore, "fishery right" must be clearly written into "property Law" and "Fisheries Law", the characteristics of fishery right should be made clear, and the system of fishery right system should be constructed in order to establish fishery right.
