论我国化妆品安全监管法律的完善

【摘要】：伴随着改革开放的深化与国民经济的迅猛发展,我国化妆品产业如同雨后春笋般快速成长,林林总总的化妆品令人目不暇接,化妆品也渐渐地变成了人们日常生活中必不可少至关重要的组成部分。但近年来,化妆品安全事故频频发生,不仅使社会的关注焦点聚集在化妆品的安全问题之上,更暴露出我国化妆品安全监管法律具有的不足与弊端,一些深层次的问题亟待解决。然而就目前而言,我国现有的研究大都集中于化妆品监管技术层面,关于化妆品安全监管法律方面的研究较少。本文采取例证法、文献综述法和多学科研究方法,从监管工作的实际情况出发,对我国化妆品监管体系的现状进行论述,通过对我国化妆品行业面临的诸多困难与挑战进行分析,继而剖析监管体系存在的具体问题,从而提出相应的建议以完善我国化妆品安全监管法律。根据发现问题、分析问题,继而解决问题的思路,在框架构建上,本文共分为五个部分：第一部分为引言,对选题背景及选题意义进行了介绍；第二部分为化妆品安全监管概述及监管背景,主要为相关概念的界定,并介绍了我国目前开展化妆品安全监管工作的背景；第三部分对美、日、欧的化妆品安全监管法律进行了概括性的介绍,论述了美国、日本及欧盟的化妆品安全监管机构、立法体系及其监管特点,并根据对发达国家和地区先进体系的分析,提出了我国化妆品安全监管工作的改进方向；第四部分对我国化妆品安全监管法律具有的主要问题进行了深入的分析,该主要问题表现为：我国化妆品安全监管法律体系存在矛盾及缺位现象,我国化妆品安全监管主体职责不清、缺乏统一有效的监管机构,以及化妆品生产及流通环节存在的主要问题；第五部分分析了改革和完善我国化妆品安全监管法律的意义,并针对上述问题提出具有针对性的建议和对策,以期改革和完善我国化妆品安全监管法律。
[Abstract]:With the deepening of reform and opening up and the rapid development of the national economy, the cosmetics industry in China has grown rapidly as a result of bamboo shoots. Cosmetics have gradually become an essential part of people's daily lives. However, in recent years, the frequent occurrence of cosmetic safety accidents not only makes the social focus on cosmetics safety issues, but also exposes the shortcomings and drawbacks of the cosmetic safety supervision law in China. Some deep problems need to be solved. However, at present, most of the existing researches in China focus on the technical aspects of cosmetic supervision, and there are few studies on the law of cosmetic safety supervision. This paper discusses the present situation of cosmetic supervision system in China, based on the example method, literature review method and multidisciplinary research method, from the actual situation of supervision work. Based on the analysis of many difficulties and challenges faced by the cosmetic industry in China, this paper analyzes the specific problems existing in the supervision system, and puts forward corresponding suggestions to perfect the law on the safety supervision of cosmetics in China. This paper is divided into five parts: the first part is the introduction, which introduces the background of the topic and the significance of the topic; The second part is the overview of cosmetic safety supervision and supervision background, mainly for the definition of related concepts, and introduces the background of China's current cosmetic safety supervision; the third part of the United States, Japan, the United States, Japan, The European cosmetic safety regulation law is introduced in a general way, and the cosmetic safety regulatory agencies, legislative system and its regulatory characteristics of the United States, Japan and the European Union are discussed, and based on the analysis of advanced systems in developed countries and regions, This paper puts forward the direction of improvement of cosmetic safety supervision in China. The fourth part analyzes the main problems existing in the law of cosmetic safety supervision in China. The main problems are as follows: there are contradictions and absence in the legal system of cosmetic safety supervision in our country, the responsibilities of the main body of cosmetic safety supervision in our country are not clear, and there is a lack of unified and effective regulatory bodies. The fifth part analyzes the significance of reforming and perfecting the law of cosmetic safety supervision in our country, and puts forward some suggestions and countermeasures in view of the above problems. In order to reform and improve our cosmetic safety supervision law.
