对网上食品交易行政监管的思考

【摘要】：网上食品交易是近年来随着计算机与互联网技术的不断发展以及人们消费观念的转变而出现的新事物，且发展势头迅猛。然而，在网上食品交易迅猛发展的过程中，食品安全也出现了一些新问题，比如网上食品经营者未能建立相关食品安全管理制度，未取得相关资质证明擅自销售食品，销售假冒伪劣食品，无法保证食品质量的个人自制食品，国家或相关行政区域命令禁止销售的食品，，消费者维权难，等等。 上述问题在目前的食品安全管理制度下很难得到有效的解决，原因在于，现行法律未明确将网上食品交易列入监管范围，相关法律法规滞后，市场准入门槛形同虚设，管辖权也未能明确。 要解决网上食品交易中存在的问题，需要完善网上食品交易行政监管制度，具体措施包括：一是对进入网络交易的食品和食品生产者严格落实市场准入标准，为此应实行网上食品交易登记备案制度，和建立网上食品交易负面清单制度；二是明确监管主体管辖权；三是引入食品安全强制责任保险制度等。通过上述制度的完善，以保障网上食品交易的安全。
[Abstract]:With the development of computer and Internet technology and the change of people's consumption concept, online food transaction is a new thing in recent years, and the development momentum is swift and violent. However, in the course of the rapid development of online food transactions, some new problems have emerged in food safety, such as the failure of online food operators to establish relevant food safety management systems and the unauthorized sale of food without obtaining relevant qualifications. The sale of fake and shoddy food, personal homemade food which cannot guarantee the quality of food, food banned by the state or relevant administrative region, consumer rights protection, etc. The problems mentioned above are difficult to solve effectively under the current food safety management system. The reason is that the current law does not explicitly include online food transactions in the scope of supervision, the relevant laws and regulations lag behind, and the barriers to market access are virtually empty. Jurisdiction is also unclear. In order to solve the problems existing in online food transactions, we need to improve the administrative supervision system of online food transactions. The specific measures include: first, strictly implementing market access standards for food and food producers who enter the network. Therefore, the system of online food transaction registration and filing should be implemented, and the negative list system of online food transaction should be established. The second is to make clear the jurisdiction of the subject of supervision, and the third is to introduce the system of compulsory liability insurance for food safety, etc. Through the improvement of the above system, to ensure the safety of online food transactions.
