高校突发事件应急管理法律机制创新研究

【摘要】：依法治国理念日益深入人心，成为国民的共识。2013年11月，党的十八届三中全会强调“推进法治中国建设”，“法治中国”是法治国家、法治政府和法治社会的综合体，吹响了法治建设的新号角。高等学校作为社会的重要组成部分，是教学育人、科学研究、传播知识、服务社会的重要基地。面对高校日益复杂的内外部环境和频发的突发事件，将高校教育管理活动纳入法制轨道已经成为高校管理的必然趋势，建立高校法制化的长效应急管理机制是依法治校的必然选择，是法治社会的必然要求，是建设法治国家方略在高等教育领域的重要体现。只有尽快完善高校应急管理的法律体系，建立应急管理长效机制，才能真正实现高等教育管理向科学化、标准化、民主化、规范化的更高水平发展。对高校突发事件应急管理法律机制进行创新研究，，要从相关理论入手，并论证高校突发事件应急管理法律机制法制化的现实紧迫性；要对现阶段我国高校应急管理法律机制的现状与问题进行深刻剖析，通过研究、借鉴发达国家和地区高校突发事件应急管理法律机制建设的成功经验，进而提出构建和创新我国高校突发事件应急管理法律机制的设想，以切实维护高校的安全稳定，保障高校社会职能的发挥。法律机制的创新并非是对现行做法进行简单的法律确认，而是着眼于高校突发事件整体应急管理总体框架和现行法律机制、基本法律原则及规则建立起一个完备、系统的应急管理法律机制大体系，以与高校应急管理全过程相适应。当前的高校应急法律机制要么不完善，要么只重点着眼于“应急处置”，而完善和创新后的法律机制做到以“应急管理”为中心向两端延伸、以“立法”为始端向下贯彻实施，实现“从预防到处置再到善后”、“从立法到执法到再到监督救济”的整体覆盖。在完善现有应急法律机制的基础上创新设计出一种高校应急管理法律机制——被良好理解为起点和终点的科学的模式，以实现高校突发事件应急管理法制化和良性运行。
[Abstract]:In November 2013, the third Plenary session of the 18th CPC Central Committee emphasized "promoting the construction of China under the rule of law." China by law "is a complex of a country ruled by law, a government ruled by law and a society ruled by law. Sounded the new horn of the rule of law construction. As an important part of society, colleges and universities are important bases for teaching and educating people, scientific research, spreading knowledge and serving the society. In the face of the increasingly complex internal and external environment and frequent emergencies in colleges and universities, it has become an inevitable trend to bring the educational management activities into the legal track of colleges and universities. It is an inevitable choice to run a university according to law, an inevitable requirement of a society ruled by law, and an important embodiment of the strategy of building a country ruled by law in the field of higher education. Only by perfecting the legal system of emergency management in colleges and universities as soon as possible and establishing a long-term mechanism of emergency management can we truly realize the higher level development of higher education management in a more scientific, standardized, democratic and standardized way. To carry on the innovation research to the university emergency management legal mechanism, we should start with the related theory, and demonstrate the reality urgency of the university emergency management legal mechanism legalization; It is necessary to deeply analyze the present situation and problems of the legal mechanism of emergency management in colleges and universities in our country at present, and draw lessons from the successful experience of the construction of the legal mechanism of emergency management of universities in developed countries and regions through the research. Then it puts forward the idea of constructing and innovating the legal mechanism of emergency management in colleges and universities in order to safeguard the safety and stability of colleges and universities and ensure the social functions of colleges and universities. The innovation of the legal mechanism is not to confirm the current practice simply, but to focus on the overall framework and current legal mechanism of the overall emergency management of emergencies in colleges and universities, and to establish a complete system of basic legal principles and rules. The system's legal system of emergency management adapts to the whole process of university emergency management. The current emergency legal mechanism in colleges and universities is either imperfect or only focuses on "emergency management", and the improved and innovated legal mechanism extends to both ends with "emergency management" as the center and "legislation" as the starting point for implementation. The whole coverage of "from prevention to treatment to rehabilitation", from legislation to law enforcement to supervision and relief. On the basis of perfecting the existing legal mechanism of emergency management, the author innovates and designs a scientific mode of university emergency management mechanism, which is well understood as the starting point and end point, in order to realize the legalization and benign operation of emergency management in colleges and universities.
