行政法视野下的公私协力行为研究

【摘要】:公私协力泛指公共部门与私人部门为了某种行政任务的实现而进行合作的所有情形。公私协力作为一项由政府为主导而推行的重要举措,备受各国政府青睐,正以不同的形态在世界各国运作着。然而我国大陆学者却很少专门对其进行研究。公私协力相关的外部法律保障机制该如何建立?当行政契约所生争议发生时该如何救济?这些都是亟待解决的问题。本文正是基于这一考量,试图将公私协力纳入到行政法学的研究范畴和框架之下,为上述问题的解决寻找一个妥善的法律方案。论文共分为三个部分。 第一部分为公私协力行为的概念界定及其发展。在这一部分中先对公私协力行为的概念、类型等作了法律界定,以之为下文的展开服务。随后以公私协力的发展动因为开端,揭示公私协力得以兴起的原因,并从域外及我国两个不同的视角,对公私协力的演进历程进行了概括分析。 第二部分从行政法视野对公私协力的法律规制进行了探讨。首先,论证了公私协力行为法律规制的必要性。其次,探讨该如何对公私协力行为进行法律规制。为界定公私协力的范围,首先应当明确法律保留原则的适用。同时,为使公私协力不脱离法律的控制,,正当程序也是法律规制应当考虑的对象。司法救济上,要判断公私协力之契约行为的公私法属性,随后在明确其为行政契约的基础上,建立适当的行政契约司法救济机制。 第三部分主要是在前文论述的基础上来考察我国公私协力行为的法律规制现状并针对当前存在的问题提出相关的制度设计思路。分两个层面来加以讨论,首先,分析总结我国公私协力行为有关立法的现状及存在的问题,并针对这些问题,提出相应的解决办法。其次,针对我国行政契约司法救济机制缺失这一现实,试图为我国行政契约司法救济机制的构建提出设计思路。
[Abstract]:Public-private collaboration refers to all situations in which the public and private sectors cooperate for the fulfilment of an administrative task. Public-private cooperation, as an important government initiative, is favored by governments all over the world, and it is operating in different forms all over the world. However, Chinese mainland scholars rarely study it specifically. How to establish an external legal protection mechanism related to public-private collaboration? How to remedy the disputes arising from the administrative contract? These are all problems to be solved. Based on this consideration, this paper attempts to bring public and private cooperation into the scope and framework of administrative jurisprudence, in order to find a proper legal scheme for solving the above problems. The thesis is divided into three parts. The first part is the definition and development of public-private cooperation. In this part, the concept and type of public-private cooperative action are defined by law, which serve for the following. Then, with the development of public-private cooperation as the beginning, this paper reveals the reasons for the rise of public-private collaboration, and analyzes the evolution of public-private cooperation from two different perspectives: outside China and outside China. The second part discusses the legal regulation of public-private cooperation from the perspective of administrative law. Firstly, the necessity of legal regulation of public-private cooperation is demonstrated. Secondly, it discusses how to regulate the public-private cooperation. In order to define the scope of public-private cooperation, the application of the principle of reservation of law should be clearly defined. At the same time, in order to make the public-private cooperation not out of the control of the law, due process should be considered in the legal regulation. In the judicial relief, we should judge the public and private legal attribute of the public-private cooperation contract, and then establish the proper judicial relief mechanism of the administrative contract on the basis of making it clear that it is the administrative contract. The third part is mainly on the basis of the previous discussion to investigate the current situation of the legal regulation of public-private cooperation in China and to put forward the relevant system design thinking in view of the existing problems. It is discussed from two aspects. Firstly, it analyzes and summarizes the current situation and the existing problems of the legislation on the behavior of public-private cooperation in China, and puts forward corresponding solutions to these problems. Secondly, aiming at the lack of judicial relief mechanism of administrative contract in China, the author tries to put forward the design ideas for the construction of judicial relief mechanism of administrative contract in China.
