土地利用管制制度的完善

【摘要】：我国当前土地利用管制制度还没有形成体系的法律规定,土地利用管制制度自身存在缺陷,还有土地利用管制工具缺乏以及管制与放松管制之间缺乏过滤手段等问题。虽然是否需要实施土地利用管制在理论上还存在争议,但是土地利用管制具有自身的合理性。在考查国外成功经验的基础之上,对中国的土地利用管制制度提出了建立系统性土地利用法律制度、完善管制制度、增加管制工具以及将管制与放松管制相结合的一些完善思路。
[Abstract]:China's current land use control system has not yet formed the legal provisions of the system, the land use control system has its own defects, there are also lack of land use control tools and the lack of filtering between regulation and deregulation, and so on. Although whether land use regulation is necessary or not is still controversial in theory, but land use control has its own rationality. On the basis of the successful experience of foreign countries, this paper puts forward the establishment of systematic land use law system and the improvement of the control system for China's land use control system. Add control tools and the combination of regulation and deregulation of some perfect ideas.
