论国务院行政规定的效力位阶

【摘要】：国务院行政规定虽然在现实生活中发挥着重要作用,但在法律规范体系内却一直处于比较"隐蔽"的地位。在行政规范体系中,国务院行政规定的效力仅次于行政法规,高于部门规章、地方政府规章以及各种其他行政规定;在行政规范体系之外,国务院行政规定的效力低于法律和地方性法规、自治条例、单行条例。判断规范性文件的效力位阶存在"从行政等级出发"和"从表现形式出发"两种思路。应该逐步摆脱从行政等级出发确定行政机关制定规范的等级的思维惯性,正确定位国务院发布的行政规定的效力位阶,自觉区分行政法规和国务院行政规定的适用场合、调整对象。
[Abstract]:Although the administrative regulations of the State Council play an important role in real life, they have always been in a "hidden" position in the system of legal norms. In the administrative normative system, the administrative provisions of the State Council are second only to administrative laws and regulations and are superior to departmental regulations, local government regulations and various other administrative provisions; Outside the system of administrative norms, the administrative provisions of the State Council are less effective than laws and local regulations, autonomous regulations and separate regulations. There are two ways to judge the validity of normative documents: "proceeding from the administrative level" and "proceeding from the form of expression". We should gradually get rid of the inertia of thinking from the administrative level to determine the level of norms formulated by the administrative organs, correctly position the level of effectiveness of the administrative provisions issued by the State Council, and consciously distinguish between the administrative regulations and the applicable occasions of the administrative regulations of the State Council. Adjust the object.
