论地方行政许可设定权的界限
[Abstract]:As the right to establish local administrative license, the essence of it is to weigh the actual needs of the local government on the premise of not violating the central legislation, in order to decide whether to establish the legislative prediction and evaluation power of administrative license. However, how to better grasp the limits of the exercise of this power under the background of fuzzy legislative authorization is a realistic subject. On the basis of analyzing the essence of this power, this paper puts forward the viewpoint of inner and outer limits. On the basis of the division of the vertical relationship between the central government and the local government, the external authority of the local administrative license establishment right is explained by the different arrangement of the set purpose and the items. From the point of view of whether or not to decide the discretion and how to choose the discretion, which is both the law of legislation and the space of legislative discretion, this paper explains the inner limits of the right of local administrative license creation.
