中外政府信息公开范围制度设计差异及其启示——兼谈《中华人民共和国档案法》第一条的修改

【摘要】：2007年4月,国务院颁布了《中华人民共和国政府信息公开条例》,并于次年5月1日始正式实施。揆诸世界各国如美、英、日等国的《信息自由法》可以发现,中外对于政府信息公开立法中公开范围的制度设计可谓大异其趣。这种迥异是立法理念与原则的产物,由此也导致了自《条例》实施数年来政府信息公开的执行情况仍然不尽如人意的效果与结果。我们以为,问题解决的关键还需遵从现代政府信息公开立法的一般法理,重塑并重构政府信息公开立法理念与理论,从而实现从"知的需求"到"知的权利"的制度转型与跨越。本文还就《中华人民共和国档案法》第一条的修改谈了一些个人看法。
[Abstract]:In April 2007, the State Council promulgated the regulations of the people's Republic of China on the publicity of Government Information, which came into effect on May 1 of the following year. The "Freedom of Information Law" in countries such as the United States, Britain, Japan and other countries in the world can be found that the system design of the scope of disclosure in the legislation of government information disclosure at home and abroad is quite different. This difference is the product of the legislative ideas and principles, which has led to the implementation of the "regulations" since the implementation of the government information disclosure for several years still unsatisfactory results and results. We think that the key to solve the problem is to conform to the general legal principle of modern government information disclosure legislation, to reshape and reconstruct the legislative idea and theory of government information disclosure. In order to realize the system transition from "need of knowledge" to "right of knowledge". This paper also gives some personal opinions on the amendment of Article 1 of the Archives Law of the people's Republic of China.
